Transition committee

1 A transition committee is hereby established for each newly amalgamated municipality, effective October 23, 2014.

1 Le présent règlement constitue un comité de transition pour chacune des municipalités nouvellement fusionnées, à compter du 23 octobre 2014.

Composition

2 The members of a transition committee are the persons elected to the council of the newly amalgamated municipality at the October 22, 2014 general election.

2 Les membres du comité de transition sont les personnes élues au conseil de la municipalité nouvellement fusionnée, lors des élections générales du 22 octobre 2014.

Purpose

3(1) The purpose of the transition committee is to make plans and preparations that the members consider necessary respecting their assuming the role of council for the newly amalgamated municipality on January 1, 2015.

Mandat

3(1) Le comité de transition a pour mandat d'établir les plans et d'effectuer les préparatifs que ses membres considèrent nécessaires pour les aider à assumer le rôle de conseil pour la municipalité nouvellement fusionnée le 1^er janvier 2015.

3(2) Examples of activities that a transition committee may engage in include

(a) planning for the governance of the newly amalgamated municipality, including giving consideration to

(i) the organizational structure of the newly amalgamated municipality and the council committees and other bodies of council that may be established, and

(ii) the procedures by which the council of the newly amalgamated municipality will govern itself;

(b) preparing to ensure that

(i) the powers, duties and functions of the newly amalgamated municipality are appropriately carried out, and

(ii) the policies and programs of the newly amalgamated municipality are appropriately developed and evaluated; and

(c) if a chief administrative officer has not been designated, considering the appointment of a chief administrative officer or the process to be followed in making such an appointment.

3(2) Le comité de transition peut notamment exercer les activités suivantes :

a) la planification de la gouvernance de la municipalité nouvellement fusionnée, y compris l'examen :

(i) de la structure organisationnelle de la municipalité nouvellement fusionnée et des comités du conseil, ainsi que des autres organismes du conseil qui pourraient être constitués,

(ii) de la procédure dont le conseil de la municipalité nouvellement fusionnée se dotera en matière de gouvernance;

b) les préparatifs visant à faire en sorte que :

(i) les attributions de la municipalité nouvellement fusionnée soient exercées de façon appropriée,

(ii) les politiques et les programmes de la municipalité nouvellement fusionnée soient élaborés et évalués de façon appropriée;

c) la nomination d'un directeur général ou le processus à suivre pour ce faire, si ce poste n'a pas déjà été pourvu.

3(3) For certainty, a transition committee may not exercise the powers, duties or functions of a council of a municipality.

3(3) Il demeure entendu que le comité de transition ne peut exercer les attributions du conseil municipal.

Meetings and support

4(1) A transition committee is to meet at the call of the person elected as head of council for the newly amalgamated municipality.

Réunions et appui

4(1) Le comité de transition se réunit sur demande de la personne élue à titre de président du conseil de la municipalité nouvellement fusionnée.

4(2) The chief administrative officer of a municipality from which the newly amalgamated municipality is to be established must provide the transition committee the resources requested to support the work of the transition committee.

4(2) Le directeur général d'une des municipalités qui fait l'objet d'une fusion doit fournir au comité de transition les ressources demandées pour appuyer le travail de ce comité.

Termination

5 Each transition committee is terminated effective December 31, 2014.

Dissolution

5 Le comité de transition est dissous le 31 décembre 2014.

Transition role of councils of amalgamated municipalities

6 To avoid doubt, during the transition period beginning on October 23, 2014 and ending on December 31, 2014, the council of a municipality from which a newly amalgamated municipality is to be established continues to be responsible for the exercise the powers, duties and functions of council in relation to the day-to-day activities of the municipality, and is subject to the limitation prescribed in the regulation that establishes the newly amalgamated municipality.

Rôle des conseils des municipalités fusionnées pendant la transition

6 Il demeure entendu que pendant la période de transition ayant lieu entre le 23 octobre et le 31 décembre 2014, le conseil d'une municipalité qui fait l'objet d'une fusion continue d'être responsable de l'exercice de ses attributions relativement aux activités quotidiennes de la municipalité et il est soumis aux limites prévues dans le règlement qui constitue la municipalité nouvellement fusionnée.

Compensation and expenses for transition committee may be determined retrospectively

7 The council of a newly amalgamated municipality may provide compensation for members attending to the work of the transition committee in its by-law passed under section 124 of The Municipal Act, and a member may be paid and accept an amount paid under that by-law for his or her attending to the work of the transition committee.

Détermination rétrospective de la rémunération et des dépenses des membres des comités de transition

7 Le conseil d'une municipalité nouvellement fusionnée peut prévoir la rémunération des membres qui participent aux activités du comité de transition dans le cadre de son règlement municipal adopté en vertu de l'article 124 de la Loi sur les municipalités. Les membres peuvent accepter les sommes payées en vertu de ce règlement.
