1 The Prosthetic, Orthotic and other Medical Devices Insurance Regulation, Manitoba Regulation 53/93, is amended by this regulation.

1 Le présent règlement modifie le Règlement sur l'assurance relative aux prothèses, aux orthèses et aux autres appareils médicaux, R.M. 53/93.
2(1) Section 2 is amended
(a) by adding "and" at the end of subclause (a)(v); and
(b) by repealing clause (e).

2(2) Section 2 is further amended by renumbering it as subsection 2(1) and adding the following as subsections 2(2) to (6):

2(2) Subject to subsections (3) and (4), an insulin pump is an insured service when each of the following conditions is met:
(a) any of the following medical practitioners makes an application for the pump on behalf of an eligible insured person using a process approved by the minister:
(i) a medical practitioner specializing in endocrinology,
(ii) a medical practitioner who is providing care to the eligible insured person in relation to the management of the person's diabetes;
(b) the pump is ordered from a supplier approved by the minister.
2(2) Sous réserve des paragraphes (3) et (4),
la pompe à insuline constitue un service assuré lorsque les conditions qui suivent sont réunies :
a) l'un ou l'autre des médecins qui suivent présente, selon un procédé approuvé par le ministre, une demande pour qu'un assuré admissible obtienne une pompe à insuline :

2(3) The medical practitioner must not make an application for an insulin pump on behalf of the eligible insured person unless the practitioner is satisfied that the eligible insured person is
(a) currently safely using an insulin pump; or
(b) capable of safely using an insulin pump and that use of the pump will assist the person in their ongoing efforts to manage their blood glucose level.
2(3) Le médecin ne peut présenter une demande pour qu'un assuré admissible reçoive une pompe à insuline que s'il est convaincu, selon le cas:
a) que l'assuré utilise actuellement une pompe à insuline de façon sécuritaire;

2(4) Despite subsections (2) and (3), an insulin pump is an insured service if the medical practitioner referred to in subclause (2)(a)(i) made an application for the pump during the period beginning on March 7, 2023, and ending on the coming into force of subsection (2) on behalf of an eligible insured person using a process approved by the minister during the time period.
2(4) Malgré les paragraphes (2) et (3), la pompe à insuline constitue un service assuré lorsque le médecin visé au sous-alinéa 2a)(i) en a fait la demande au nom d'un assuré admissible au cours de la période commençant le 7 mars 2023 et se terminant à l'entrée en vigueur du paragraphe (2) et selon un procédé que le ministre avait approuvé pour cette période.
2(5) An application made on behalf of an eligible insured person during the period beginning on March 7, 2023, and ending on the coming into force of this subsection that was not accepted is eligible for reconsideration, and an insulin pump ordered by the eligible insured person after the date of the application is an insured service if the conditions in subsections (2) and (3) are met.
2(5) La demande présentée au nom d'un assuré admissible au cours de la période commençant le 7 mars 2023 et se terminant à l'entrée en vigueur du présent paragraphe qui n'a pas été acceptée est admissible à un réexamen; toute pompe à insuline commandée par l'assuré admissible après la date de la présentation de la demande constitue un service assuré si les conditions énoncées aux paragraphes (2) et (3) sont remplies.
2(6) For the purpose of subsections (2) to (5), "eligible insured person" means an insured person who
(a) is at least 18 years of age;
(b) has been diagnosed with type 1 diabetes; and
(c) has not received an insulin pump within the preceding five years under this regulation or under the Manitoba Pediatric Insulin Pump Program.
2(6) Pour l'application des paragraphes (2) à (5), « assuré admissible » s'entend de tout assuré qui remplit les conditions suivantes :

3 Section 2.2 is amended by striking out "2(a)(vi)" in the section heading and in the section and substituting "2(1)(a)(vi)".

4 Section 2.3 is amended, in the part before clause (a), by striking out "clauses 2(a) to (e)" and substituting "subsections 2(1) and (2)".

Coming into force
5(1) Subject to subsection (2), this regulation comes into force on the day it is registered under The Statutes and Regulations Act.

5(1) Sous réserve du paragraphe (2), le présent règlement entre en vigueur à la date de son enregistrement en vertu de la Loi sur les textes législatifs et réglementaires.
5(2) Subsection 2(4) is deemed to have come into force on March 7, 2023.
