Corrections and minor changes made under the authority of section 25 of The Statutes and Regulations Act

General information about corrections and minor changes

The Statutes and Regulations Act requires Manitoba legislation to be published on the Manitoba Laws website. Under subsection 25(1) of the Act, the chief legislative counsel is required to correct consolidation and publication errors. Under subsection 25(2) of the Act, the chief legislative counsel may make minor corrections or changes to the consolidated version of an Act or regulation without changing its legal effect.

Notice of the following types of minor changes must be given:

  • replacing a description of a date or time with the actual date or time; [s. 25(2)(f)]
  • replacing a reference to a bill or any part of a bill with a reference to the resulting Act or part of the Act after the bill is enacted and assigned a chapter number; [s. 25(2)(g)]
  • removing a reference to a contingency in a provision that is stated to come into effect when or if that contingency occurs, if that contingency has occurred, or is required as a result of removing such a reference; [s. 25(2)(h)]
  • updating a reference to a person, office, organization, place or thing if an Act provides that references to it are deemed or considered to be references to another person, office, organization, place or thing; [s. 25(2)(i)]
  • updating a reference to reflect a change in the name, title, location or address of a person, office, organization, place or thing, other than
    • a change in the name or title of a document adopted or incorporated by reference unless it was adopted or incorporated as amended from time to time, and
    • a change in the title of a minister or the name of a department; [s. 25(2)(j)]
  • updating a reference to a minister or department when, under subsection 5(3) of The Executive Government Organization Act, the Act is to be read as if it were amended as necessary to give effect to an order in council made under that Act; [s. 25(2)(k)]
  • correcting an error in the numbering of a provision or other portion of an Act, or making a change to a cross-reference required as a result of such a correction; [s. 25(2)(l)]
  • correcting an obvious error in a cross-reference, if it is obvious what the correction should be; [s. 25(2)(m)]
  • if a provision of a transitional nature is contained in an amending Act, incorporating it as a provision of the consolidated Act and make any other changes that are required as a result; [s. 25(2)(n)]
  • removing a provision that is deemed by The Interpretation Act to have been repealed because it has expired, lapsed or otherwise ceased to have effect. [s. 25(2)(o)]

Interpretation

1(1)   In this regulation,

"designated route" means a line or course of travel described in section 3; (« chemin désigné »)

"director" means the Director of the Wildlife and Fisheries Branch of the Department of Agriculture and Resource Development; (« directeur »)

"game hunting area" means a game hunting area designated under The Wildlife Act; (« zone de chasse au gibier »)

"purpose connected with hunting", when used in relation to a vehicle, means the use of a vehicle to transport a hunter, hunting supplies or hunting equipment to or from a hunting location or a hunting campsite, but does not include the use of a vehicle to chase, drive, flush, pursue, follow after or on the trail of or search for a wild animal; (« fins liées à la chasse »)

"well-travelled trail" means a trail that is well established and regularly used by public vehicular traffic as evidenced, in non-cultivated areas, by the absence of green trees and shrubbery on the travelled portion, and includes, if the trail ordinarily crosses a field that is or has been cultivated for the purpose of growing a crop for seed or feed, the most direct path across the field to access the continuation of the trail or a hunting area. Interprétation

1(1)   Les définitions qui suivent s'appliquent au présent règlement.

GAME HUNTING AREA AND DESIGNATED ROUTE RESTRICTIONS

Designated route restrictions

3(1)   Subject to subsections (4), (5), (6) and (7), no person shall use a vehicle

(a) for a purpose connected with hunting deer, elk or moose between August 12 and December 22 in game hunting areas 17A, 18 and 26 or in Turtle Mountain Provincial Park;

(b) for a purpose connected with hunting black bears between Septembe 16 and October 13 in game hunting area 17A; or

(c) for a purpose connected with hunting black bears between August 26 and September 15 in game hunting area 18;

except on a designated route.

3(2)   The designated routes on which vehicles may be used under this section are shown on the following plans filed in the Winnipeg Office of the Director of Surveys:

3(3)   The director may, in writing, order the closure or re-opening of a designated route to vehicles for use for a purpose connected with hunting.

3(4)   The director may issue a permit authorizing the use of a vehicle to transport people, supplies or equipment by the most direct route to and from a building not located on a designated route if the building is

(a) on private land; or

(b) on Crown land for which a permit or lease authorizing occupation of the land has been issued under an Act of the Legislature.

3(5)   A person who has lawfully killed a big game animal may use a vehicle other than on a designated route for the sole purpose of transporting the animal by the most direct route from the place of killing

(a) to a site within an area listed in subsection (2) where an alternate means of transport is located; or

(b) out of an area listed in subsection (2).

3(5)   Quiconque abat licitement un gros gibier peut utiliser un véhicule ailleurs que sur un chemin désigné dans le seul but de transporter l'animal par la voie la plus directe jusqu'à :

3(6)   With prior written permission from an officer, a hunter may use a vehicle other than on a designated route to remove his or her hunting camp on the first Sunday following the closing of a deer, elk or moose season from a game hunting area in which the hunter held a licence to hunt.

3(7)   A person may use a vehicle for a purpose connected with hunting deer on a developed road, a well-travelled trail and a waterway between August 12 and December 22 in that part of game hunting area 26 described in Plan No. 20589 filed in the Winnipeg office of the Director of Surveys.

Restrictions in various GHAs

4(1)   Subject to section 3 (designated route restrictions), a person may only use a vehicle for a purpose connected with hunting deer, moose or elk on a developed road, a well-travelled trail or a waterway

(a) from August 12 to December 22, in game hunting areas 5, 6, 6A, 7, 8, 12, 13, 14, 14A, 15, 15A, 18B, 18C, 19, 19A, 19B, 20, 21, 21A, 22, 24, 25, 25A, 25B, 26, 27, 28, 29, 29A and 30 to 36;

(b) from August 12 to January 26 in game hunting areas 23 and 23A; and

(c) from August 12 to December 22 in game hunting areas 13A and 18A.

4(1.1)   In the portion of game hunting area 30 that is occupied by CFB Shilo, no person shall use a vehicle for a purpose connected with hunting wildlife except on such developed roads, well-travelled trails or waterways as are designated for that purpose by the base commander of CFB Shilo on a written notice or map posted or made available to members of the public at the offices of CFB Shilo.

Disabled hunter permits

5(1)   The director may issue a disabled hunter permit to a person whose mobility is severely impaired by a permanent injury, authorizing the use of

(a) an off-road vehicle in a game hunting area in which vehicle use for a purpose connected with hunting a big game animal is restricted to cars, trucks, or power boats;

(b) a vehicle off a designated route in a game hunting area in which vehicle use for a purpose connected with hunting a big game animal is restricted to designated routes; or

(c) a vehicle off a developed road, a well-travelled trail or a waterway in a game hunting area in which vehicle use for a purpose connected with hunting a big game animal is restricted to a developed road, a well-travelled trail or a waterway.

5(1)   Le directeur peut délivrer à toute personne dont la mobilité a été considérablement réduite à cause d'une blessure permanente un permis de chasse pour personne handicapée autorisant l'utilisation :

a) d'un véhicule à caractère non routier dans une zone de chasse au gibier où les seuls véhicules pouvant être utilisés à des fins liées à la chasse au gros gibier sont les automobiles, les camions et les embarcations motorisées;

b) d'un véhicule ailleurs que sur un chemin désigné dans une zone de chasse au gibier où l'utilisation de véhicules à des fins liées à la chasse au gros gibier est permise uniquement sur les chemins désignés;

c) d'un véhicule ailleurs que sur une route aménagée, un sentier très fréquenté ou un cours d'eau dans une zone de chasse au gibier où l'utilisation de véhicules à des fins liées à la chasse au gros gibier est permise uniquement sur les routes aménagées, les sentiers très fréquentés ou les cours d'eau.

5(2)   The director may issue a disabled hunter permit to a person who is paraplegic or otherwise permanently confined to a wheelchair. The permit authorizes the holder

(a) to discharge a firearm from a vehicle pulled over to the side of a public road within a municipality or a local government district for the purpose of hunting game birds, if

(i) the vehicle's motor is not in operation, and

(ii) the firearm is discharged away from the road; and

(b) to discharge a firearm from a vehicle for the purpose of hunting a game bird or big game animal if

(i) the vehicle is off a provincial trunk highway, a provincial road or a public road within a municipality or a local government district, or the road allowance associated with any such thoroughfare, and

(ii) the vehicle's motor is not in operation.

5(2)   Le directeur peut délivrer un permis de chasse pour personne handicapée aux personnes qui sont paraplégiques ou qui doivent en permanence se déplacer en fauteuil roulant. Ce permis les autorise :

(ii) le moteur du véhicule est éteint.

5(3)   An application for a permit or authorization under subsections (1) or (2) shall be accompanied by written certification from a medical doctor describing the physical impairment of the applicant along with any clarification that may be necessary to permit a layperson to understand why the permit or authorization is warranted.

7   Except under authority of a permit issued by the director, no person shall use a power boat in that area of the province identified as the Delta Marsh on Plan No. 20226 filed in the office of the Director of Surveys at Winnipeg.
