Tribunals with jurisdiction on all constitutional law questions
1 The following administrative tribunals have jurisdiction to determine all questions of constitutional law:
(a) the Automobile Injury Compensation Appeal Commission established under The Manitoba Public Insurance Corporation Act;
(b) the complaints investigation committee established under The Legal Profession Act;
(c) the discipline committee established under The Legal Profession Act;
(d) the Manitoba Human Rights Commission;
(e) the Manitoba Labour Board;
(f) the Manitoba Securities Commission;
(g) the Public Utilities Board;
(h) the Residential Tenancies Commission.

2 The Surface Rights Board has jurisdiction to determine a question of constitutional law that involves the distribution of powers under the Constitution of Canada between the federal government and provincial governments.

2 La Commission des droits de surface a compétence pour statuer sur les questions de droit constitutionnel liées à la distribution des pouvoirs entre les gouvernements fédéral et provinciaux, laquelle est prévue par la Constitution du Canada.
Form of notice of constitutional law question
3 A notice of constitutional law question in a proceeding before a designated tribunal must contain the following information:
(a) the name of the proceeding;
(b) the date, time and place for the hearing of submissions in the proceeding;
(c) the provision of an Act or regulation that is subject to challenge;
(d) if there is an allegation of a denial or infringement of a right or freedom, the specific right or freedom that was denied or infringed;
(e) an outline of the arguments the person intends to make on the question of constitutional law that they have raised.
Forme de l'avis de question de droit constitutionnel
3 L'avis de question de droit constitutionnel remis dans le cadre d'une instance devant un tribunal administratif désigné comporte les renseignements suivants :
a) le nom de l'instance;
b) la date, l'heure et le lieu de l'audition des observations dans le cadre de l'instance;
c) la disposition d'une loi ou d'un règlement qui fait l'objet de la contestation;

Coming into force
4 This regulation comes into force on the same day that The Administrative Tribunal Jurisdiction Act, S.M. 2021, c. 28, comes into force.
