The Winnipeg Transfer Railway Company (Limited) Railway Line Extension Act

WHEREAS An Act to empower The Winnipeg Transfer Railway Company (Limited), to extend their line of Railway was assented to March 2, 1894;

AND WHEREAS it is considered advisable to continue this Act in the body of Manitoba's laws in its original form without revision;

AND WHEREAS the Minister of Justice has caused this Act to be prepared in English and French for re-enactment in accordance with a judgment dated June 13, 1985 and an order dated November 4, 1985 of the Supreme Court of Canada;

THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Extension of Transfer Railway authorized

In addition to the lines of railway already constructed by "The Winnipeg Transfer Railway Company (Limited)," the said company may acquire, lay out, construct, and complete a branch of said railway from a point on the line of said railway between the south side of Bannatyne Street and the south side of James Street in a westerly direction between Bannatyne and Market Streets in the said City of Winnipeg, not exceeding in length thirteen hundred feet.

Railway Act of Manitoba to be incorporated herewith

The several clauses of the Railway Act of Manitoba shall be and the same are hereby incorporated with and shall be deemed to be part of this Act, except in so far as the same are inconsistent with this Act; provided that nothing herein contained shall be construed to contravene the jurisdiction of the Parliament of Canada, and the provisions of this Act shall in all cases be deemed and construed to be limited to the jurisdiction of the Legislature of the Province of Manitoba.

Time for completion

Said branch railway shall be completed within two years from the coming into force of this Act.

When Act shall come into force

This Act shall come into force on the day it is assented to.

NOTE:  This Act replaces S.M. 1894, c. 48.
