THE STATUTES CORRECTION AND MINOR AMENDMENTS ACT, 2008

(Assented to October 9, 2008)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

THE ADOPTION ACT

C.C.S.M. c. A2 amended

1(1)

The Adoption Act is amended by this section.

1(2)

Subsection 1(1) of the French version is amended in clause (b) of the definition "agence extraprovinciale" by striking out "toute autre organisation ou fonctionnaire du gouvernement" and substituting "tout autre organisation ou fonctionnaire d'un gouvernement".

Clause 19(b) of the French version is amended by striking out "aient été faits" and substituting "ont été faits".

(a) in subclause (d)(i), by adding ", common-law partner" after "a spouse";

(c) by replacing everything after subclause (d)(ii) with the following:

and for this purpose, "common-law partner" of a particular individual means another individual, who not being married to the particular individual, is cohabiting with him or her in a conjugal relationship of some permanence;

Access to wells and records

An officer of the department authorized by the minister has access to all wells, and to all records, plants and equipment relating to or used in, or in connection with, wells and the drilling of wells.  Every well driller and owner must permit such an officer to enter upon the premises at all reasonable times, inspect any wells, operations, records, plants or equipment there, and take samples or carry out tests or examinations that the officer considers necessary.

(a) in the part before clause (a), by striking out "the director" and substituting "an officer of the department authorized by the minister"; and

The University of Manitoba Act is amended

(a) in subsection 22(1), by striking out "Minister of Advanced Education and Training" and substituting "Minister of Advanced Education and Literacy"; and

(b) in clauses 26(1)(q) and 37(c), by striking out "Deputy Minister of Advanced Education and Training" and substituting "Deputy Minister of Advanced Education and Literacy".

THE VITAL STATISTICS ACT

The Vital Statistics Act is amended by this section.

Clause 3(6)(a) is amended by striking out "husband" and substituting "spouse" wherever it occurs.

Section 39 is replaced with the following:

Annual report

The director must prepare a statistical report of the births, stillbirths, marriages, common-law relationships, deaths, adoptions and changes of name for the previous calendar year and include it in the annual report required by subsection 24(1) of The Special Operating Agencies Financing Authority Act.

THE WATER POWER ACT

The Water Power Act is amended by this section.

Section 1 is amended

(a) by repealing the definition "director"; and

(b) by adding the following definition:

"department" means the department of government over which the minister presides and through which this Act is administered; (« ministère »)

The centred heading before section 2 is replaced with "ADMINISTRATION OF THE ACT".

In the following provisions, "Water Branch" is struck out wherever it occurs and "department" is substituted:

The Water Resources Administration Act is amended by this section.

Section 1 is amended by repealing the definition "branch".

Subsection 2(3) is amended

(a) in the part before clause (a), by striking out "through the branch and";

(b) by repealing clause (c); and

(c) by replacing clause (f) with the following:

(f) The Water Supply Commissions Act.

Subsection 2(4) is amended

Restricting access to floodway

2.1(2)

Without limiting the generality of subsection (1) and despite anything contained in this Act, the Manitoba Floodway Authority

(a) has the power and authority to deny or restrict access to the floodway to any person other than an employee or officer of the government who requires access to the floodway in the course of his or her duties; and

(b) may require a person to obtain approval from it before undertaking any activity on the floodway or on Crown land near the floodway, and may impose conditions on an approval given to a person.

Clause 7(f) is amended by striking out "Minister of Intergovernmental Affairs and Trade" and substituting "Minister of Intergovernmental Affairs".

THE WILDLIFE ACT

"foreign resident" means a person who is not a resident or a Canadian citizen; (« résident étranger »)

Section 20 is amended

(a) by replacing the section heading with "Prohibitions re protected species"; and

(b) by striking out "listed in Division 6 of Schedule A" and substituting "that is listed or designated as a protected species under this Act or the regulations".

Subsection 69.1(1) is amended by adding "The Endangered Species Act," after "this Act,".

THE WILD RICE ACT

Delegation by minister

The minister may delegate to an employee of the government any power conferred or duty imposed on the minister under this Act or the regulations, except the power to make regulations.

THE CITY OF WINNIPEG CHARTER

If the Lieutenant Governor in Council considers it in the public interest and advisable for the purpose of carrying out or participating in a program or project, the Lieutenant Governor in Council may, by regulation, order that a by-law, resolution, decision or procedure passed, made or required under this Act does not apply to and is not binding on an agency or person, including a statutory corporation or institution, named in the regulation for purposes set out in the regulation.

THE WORKERS COMPENSATION ACT

Sections 71 and 71.2 of the English version are amended by striking out "assembly" wherever it occurs, including in the section headings, and substituting "Assembly".

COMING INTO FORCE

Coming into force

This Act, except sections 25, 28, 56, 75 and 79, subsections 11(2) to (6) and subsections 50(2) and (3), comes into force on the day it receives royal assent.

Subsections 11(3) and (4) come into force on the same day that subsection 3(5) and clause 3(6)(c) of The Consumer Protection Amendment Act (Cost of Credit Disclosure and Miscellaneous Amendments, S.M. 2005, c. 16, come into force.

Subsections 11(2), (5) and (6) are deemed to have come into force on April 1, 2007.

Section 25 is deemed to have come into force on June 16, 2005.
