An Act to amend The Public Schools Act

(Assented to July 11, 1985)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Clause 1(21.1) of The Public Schools Act, being chapter 33 of the Statutes of Manitoba, 1980 (chapter P250 of the Continuing Consolidation of the Statutes of Manitoba), is amended by striking out the words "education support" in the 2nd line of the definition of "support" and substituting therefor the words "government support to education".

Subsec. 171(1) am.

The definition of "education support program" as set out in subsection 171(1) of the Act is repealed and the following definition is added thereto, immediately following the definition of "farm and residential property" : "government support to education program" means the program of providing support administered by the finance board under this Part and the regulations;.

Definition of "eligible expenditure" rep.

The definition of "eligible expenditure" in subsection 171(1) of the Act is repealed.

Sec. 172 rep.

Section 172 of the Act is repealed.

Subsec. 173(1) am.

Subsection 173(1) of the Act is amended

(a) by striking out the words "education support" in the 3rd line thereof and substituting therefor the words "government support to education"; and

(b) by adding thereto at the end thereof the words and figures "except in order to provide each school division in 1986 and subsequent years, the same amount of support as in the preceding year, providing there is no reduction in services".

Section 174 of the Act is amended by striking out the words "education support" in the 7th line thereof and substituting therefor the words "government support to education".

Cls. 175(1)(b) to (h) rep. and sub.

Clauses 175(1) (b) to (h) of the Act are repealed and the following clauses are substituted therefor:

(b) prescribing the manner in which support to be provided to school divisions under this Part and the regulations shall be calculated;

(c) prescribing the terms and conditions subject to which support shall be provided to school divisions;

(d) prescribing procedures by which school divisions may submit matters to the finance board for approval;

(e) notwithstanding any other provision of this Act, authorizing or requiring school divisions to transport pupils;

(f) prescribing the times at which and the manner in which municipalities shall remit to the finance board and to the school division amounts required to be remitted under this Part.

Sec. 178 rep. and sub.

Section 178 of the Act is repealed and the following section is substituted therefor:

Estimate of expenses and revenue of school divisions.

On or before January 15, in each year, the school board of each school division shall submit to the finance board in a form and manner prescribed by the finance board, a detailed estimate of its expenses for all purposes and revenues from all sources for that year.

Section 180 of the Act is repealed.

Subsec. 181(1) rep. and sub.

Subsection 181(1) of the Act is repealed and the following subsection is substituted therefor:

Estimate of finance board requirements.

181(1)

On or before January 1 in each year the finance board shall calculate an estimate of its financial requirements for that year and shall notify the minister of that amount as the estimate of cost of the government support to education program for that year including the costs of administering the government support to education program through the finance board.

Subsection 182(2) of the Act is repealed and the following subsection is substituted therefor:

Education levies.

In the year 1985, subsection (1) applies but the rates of levies to be calculated under clause (1)(a) are fixed at

(a) 43.7 mills on education farm and residential assessment; and

(b) 81.7 mills on education other assessment.

Subsection 189(1) of the Act is amended by striking out the words and figures "Subject to section 190" in the 1st line thereof.

Section 190 of the Act is repealed.

Section 193 rep. and sub.

Section 193 of the Act is repealed and the following section is substituted therefor:

Validation of 1985 estimates, etc.

Notwithstanding that this Part was enacted after the finance board made calculations of the effect in the year 1985 of the government support to education program for which provision is made in this Part

(a) all calculations, estimates, payments and things done or made by the finance board in the year 1985 in anticipation of the enactment of this Part and the coming into effect of the government support to education program for which provision is made in this Part;

(b) all apportionments, notices, statements and things done, made or sent in the year 1985 by school divisions on the basis of calculations, estimates and things done by the finance board as mentioned in clause (a); and

(c) all by-laws imposing levies passed in the year 1985 by municipalities and all levies imposed on property in the year 1985 by municipalities on the basis of apportionments, notices, statements and things mentioned in clause (b);

are validated and confirmed.

Section 198 of the Act is amended by striking out the words

"foundation program" in the 3rd line and again in the 5th line thereof and substituting therefor in each case, respectively, the words "government support to education program".

Commencement of Act.

This Act comes into force on the day it receives the royal assent.
