General information about corrections and minor changes
The Statutes and Regulations Act requires Manitoba legislation to be published on the Manitoba Laws website. Under subsection 25(1) of the Act, the chief legislative counsel is required to correct consolidation and publication errors. Under subsection 25(2) of the Act, the chief legislative counsel may make minor corrections or changes to the consolidated version of an Act or regulation without changing its legal effect.
Notice of the following types of minor changes must be given:
- replacing a description of a date or time with the actual date or time; [s. 25(2)(f)]
- replacing a reference to a bill or any part of a bill with a reference to the resulting Act or part of the Act after the bill is enacted and assigned a chapter number; [s. 25(2)(g)]
- removing a reference to a contingency in a provision that is stated to come into effect when or if that contingency occurs, if that contingency has occurred, or is required as a result of removing such a reference; [s. 25(2)(h)]
- updating a reference to a person, office, organization, place or thing if an Act provides that references to it are deemed or considered to be references to another person, office, organization, place or thing; [s. 25(2)(i)]
- updating a reference to reflect a change in the name, title, location or address of a person, office, organization, place or thing, other than
- a change in the name or title of a document adopted or incorporated by reference unless it was adopted or incorporated as amended from time to time, and
- a change in the title of a minister or the name of a department; [s. 25(2)(j)]
- updating a reference to a minister or department when, under subsection 5(3) of The Executive Government Organization Act, the Act is to be read as if it were amended as necessary to give effect to an order in council made under that Act; [s. 25(2)(k)]
- correcting an error in the numbering of a provision or other portion of an Act, or making a change to a cross-reference required as a result of such a correction; [s. 25(2)(l)]
- correcting an obvious error in a cross-reference, if it is obvious what the correction should be; [s. 25(2)(m)]
- if a provision of a transitional nature is contained in an amending Act, incorporating it as a provision of the consolidated Act and make any other changes that are required as a result; [s. 25(2)(n)]
- removing a provision that is deemed by The Interpretation Act to have been repealed because it has expired, lapsed or otherwise ceased to have effect. [s. 25(2)(o)]

Definitions
1 The following definitions apply in this Part.
"apprentice" means an apprentice as defined in section 1 of The Apprenticeship and Certification Act. (« apprenti »)
"journeyperson" means a person who, in respect of a trade listed in Part 1 of the table in Schedule A,
(a) holds
(i) a certificate of qualification issued under The Apprenticeship and Certification Act, or
(ii) a certificate of proficiency issued by a recognized authority; or
(b) has worked in the trade for a period of not less than six years and is able to demonstrate that he or she has acquired the skills of the trade. (« ouvrier qualifié »)
"major building construction project" means
(a) the construction of or an addition to one of the following types of buildings or structures:
(i) a power generating station or spillway,
(ii) an oil refinery, a chemical plant, a petroleum pumping station or a plant that processes oil, gas or both oil and gas,
(iii) a smelter, mineral refinery or a steel mill,
(iv) a pulp mill, paper mill, or pulp and paper mill,
(v) a brewery or a distillery,
(vi) a compressor station,
(vii) a mining installation above the surface of the ground;
(b) the construction of or an addition to one of the following types of buildings, if the total floor space of the construction or addition exceeds 2,325 m2 (25,000 sq. ft.) of floor space:
(i) a hospital,
(ii) an apartment building,
(iii) a residential, commercial, industrial, community, government, municipal or school building; or
(c) the construction of or an addition to more than one of the types of buildings under clause (b), if
(i) the total floor space of all the buildings or additions constructed exceeds 2,325 m2 (25,000 sq. ft.) of floor space, and
(ii) the construction or additions are done under a single contract or under several contracts between the same parties that are entered into at the same time. (« ouvrage important »)
"sector" means the industrial, commercial and institutional sector of the construction industry. (« secteur »)
"skilled tradesperson" means a person who
(a) has worked 3,600 or more cumulative hours in one of the trades listed in Part 2 of the table in Schedule A; or
(b) had worked 2,400 or more cumulative hours in one of the trades listed in Part 2 of the table in Schedule A prior to September 1, 2025. (« ouvrier spécialisé »)
"trainee" means a person, other than a skilled tradesperson, who is employed in one of the trades listed in Part 2 of the table in Schedule A on a construction project in the sector or on a major building construction project. (« stagiaire »)
"Trainee 1" means a trainee who has worked fewer than 1,200 cumulative hours in the trade. (« stagiaire 1 »)
"Trainee 2" means a trainee who has worked 1,200 or more, but fewer than 2,400, cumulative hours in the trade. (« stagiaire 2 »)
"Trainee 3" means a trainee who has worked 2,400 or more cumulative hours in the trade. (« stagiaire 3 »)
"Winnipeg area" means the area within a 48 kilometre (30 mile) radius of the intersection of Osborne Street and Broadway Avenue in the City of Winnipeg. (« région de Winnipeg »)

Additions and renovations
2 When an existing building is renovated and an addition is made to it at the same time, the project is a major building construction project if one-half of the square footage involved in the renovation plus the total square footage of the addition exceeds 2,325 m2 (25,000 sq. ft.) of floor space.

3(1) For the period beginning September 1, 2025, and ending April 30, 2026, the minimum wage per hour payable to an employee listed in Column 1 of the table in Schedule A who is employed in the sector or on a major building construction project is the hourly minimum wage rate set out opposite in Column 2 of the table.

Apprentices — minimum wages and ratios
4(1) Despite any other provision of this regulation, the minimum wage per hour payable to an apprentice is the hourly wage rate in the applicable trade regulation made under The Apprenticeship and Certification Act.

4(2) An employer must not exceed the ratio of apprentices to journeypersons that may be employed by an employer under the Apprenticeship and Certification — General Regulation, Manitoba Regulation 154/2001 or the designated trade regulation for the relevant trade, whichever is applicable.

5 The standard hours of work for employees employed in the sector or on a major building construction project are 40 hours per week and 10 hours per day.

9 In this Part, "Winnipeg" means the City of Winnipeg, and includes all lands outside the City of Winnipeg that are within
(a) the Perimeter Highway; or
(b) 0.8 kilometres (one-half mile) of the Perimeter Highway.

Hourly minimum wage rate — heavy construction
10 The minimum wage per hour payable to an employee who is in a classification listed in Column 1 of the table in Schedule B and is employed in the heavy construction sector is as follows:
(a) for the period beginning September 1, 2025, and ending April 30, 2026, the hourly minimum wage rate set out opposite in Column 2 of the table in Schedule B;
(b) for the period beginning May 1, 2026, and ending April 30, 2027, the hourly minimum wage rate set out opposite in Column 3 of the table in Schedule B;
(c) for any period on or after May 1, 2027, the hourly minimum wage rate set out opposite in Column 4 of the table in Schedule B.

(c) 50 hours per week, for employees in the heavy construction sector of the construction industry outside of Winnipeg.

13 For the purpose of section 19.1 of The Construction Industry Wages Act, a "work camp" means a construction project in a remote area where room and board are supplied to employees employed on the project.

Abrogation

Coming into force
