The Menno Simons College Incorporation Act
WHEREAS the persons hereinafter named, by their petition, prayed that Menno Simons College should be incorporated: Dr. David Friesen, Abram J. Thiessen, Dr. Gerhard Lohrenz and Henry Redekopp;
AND WHEREAS their prayer was granted, and resulted in the enactment of an Act to Incorporate Menno Simons College, assented to June 30, 1982;
AND WHEREAS the Minister of Justice has caused the Act to be prepared in English and French for re-enactment in accordance with a judgment dated June 13, 1985 and an order dated November 4, 1985 of the Supreme Court of Canada;
THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
Menno Simons College (hereinafter referred to as "the College") is continued as a corporation consisting of those persons who were members on the coming into force of this Act and such other persons as become members of the College.
The objects of the College shall be the education of students and the promotion of knowledge according to the principles of the Mennonite religion.
The members of the College shall be those persons who from time to time become members in accordance with the by-laws of the College.
The members of the College shall have full power and authority to make and establish from time to time such rules, orders, regulations, and by-laws as they shall deem useful and necessary, for the system of education in and for the management of the property of, the College; and shall have the power to amend, change, or repeal such orders, rules, regulations and by-laws as they shall deem convenient; provided, that nothing contained in such orders, rules, regulations and by-laws shall be contrary to the laws of Canada or Manitoba or contrary to any provisions of this Act.
The head office of the College shall be Winnipeg or at such other place in Manitoba as may be determined from time to time by the College.
The College may in its own name purchase, acquire, hold, possess, and enjoy any lands, tenements and heritaments, real and immovable property and estate within the province for use and occupation as, or for the better enjoyment of, college buildings, offices and residences, professors, tutors, students and officers and the College may hypothecate, mortgage, alienate, and dispose of any of the property and may purchase, acquire and hold other properties in their stead.
The College may in its own name acquire real estate or interest therein by gift, devise, bequest or otherwise, and may sell, mortgage, hypothecate, or dispose of any such property, and the proceeds of disposition of any such property and any other monies belonging to the College may be invested in any securities authorized by the laws of the province for the investment of trust funds.
All the property belonging to the corporation shall at all times be exclusively applied and appropriated to the advancement of education.
The College may apply to affiliate with any Manitoba University and shall give instruction in such subjects and courses as the College may determine.
The College shall submit to the Minister of Education within six months after the close of each school year a report respecting:
(a) the number of teachers employed in the various fields of instruction;
(b) the number of students in the various fields of instruction;
(c) the number of degrees, diplomas, and certificates in the various fields granted by the college; and
(d) such particulars of the course of instruction pursued as the minister may require during the immediately preceding school year.
Every report submitted under subsection (1) shall contain an audited statement of the affairs of the College for the immediately preceding reporting period and shall be in such form and contain such information as the minister may require.
In addition to the reports required under subsections (1) and (2), the College shall submit to the minister such other reports as may be required from time to time.
The College in its corporate name shall have the power to grant degrees, including honourary degrees, diplomas, and certificates of standing on any subjects and courses pursued by the College.
