It has been in effect since November 14, 1990, when this Act came into force.
The Transfer of the Assets and Liabilities of The Community Chest of Greater Winnipeg to The United Way of Greater Winnipeg Act, R.S.M. 1990, c. 196

WHEREAS The Community Chest of Greater Winnipeg (hereinafter referred to as "the chest") was incorporated by An Act to incorporate The Community Chest of Greater Winnipeg, being chapter 104 of the Statutes of Manitoba, 1950 (First Session);
AND WHEREAS by An Act to incorporate the United Way of Greater Winnipeg, being chapter 128 of the Statutes of Manitoba, 1965, United Way of Greater Winnipeg was incorporated and was authorized to take over and assume the existing assets and liabilities of the chest;
AND WHEREAS by agreement in writing dated November 1, 1965, the chest and United Way of Greater Winnipeg entered into an agreement respecting the take-over and assumption of all assets and liabilities of the chest by United Way of Greater Winnipeg ;
AND WHEREAS it was further agreed between the chest and United Way of Greater Winnipeg that the chest would transfer all its estate and interest in any gift or other devise made in favour of the chest;
AND WHEREAS the chest, by its petition, prayed that certain provisions should be enacted;
AND WHEREAS its prayer was granted, and resulted in the enactment of An Act respecting Transfer of the Assets and Liabilities of The Community Chest of Greater Winnipeg to the United Way of Greater Winnipeg and to repeal the Acts of Incorporation of The Community Chest of Greater Winnipeg, assented to April 27, 1966;
AND WHEREAS An Act to incorporate United Way of Greater Winnipeg was subsequently amended to change the name of the corporation to United Way of Winnipeg (hereinafter referred to as "united way") and the Act was re-enacted as The United Way of Winnipeg Incorporation Act;
AND WHEREAS the Minister of Justice has caused the Act to be prepared in English and French for re-enactment in accordance with a judgment dated June 13, 1985 and an order dated November 4, 1985 of the Supreme Court of Canada;
ATTENDU QUE l'organisme dénommé « The Community Chest of Greater Winnipeg » (ci-après appelé la « Caisse ») a été constitué en corporation par la loi intitulée « An Act to incorporate The Community Chest of Greater Winnipeg », qui constitue le chapitre 104 des « Statutes of Manitoba, 1950 (First Session) »;
ATTENDU QUE par la loi intitulée « An Act to incorporate the United Way of Greater Winnipeg », qui constitue le chapitre 128 des « Statutes of Manitoba, 1965 », l'organisme dénommé « United Way of Greater Winnipeg » a été constitué en corporation et autorisé à prendre en charge l'actif et le passif existants de la Caisse;
ATTENDU QU'en vertu d'une entente écrite datée du 1er novembre 1965, la Caisse et « United Way of Greater Winnipeg » ont convenu de la prise en charge de l'actif et du passif de la Caisse par « The United Way of Greater Winnipeg »;
ATTENDU QUE la Caisse et « United Way of Greater Winnipeg » ont en outre convenu que la Caisse transférerait tous ses biens et intérêts relatifs aux dons ou aux legs faits en sa faveur;
ATTENDU QUE la Caisse a demandé l'édiction de certaines dispositions;
ATTENDU QUE sa demande a été reçue et qu'il en a résulté l'adoption de la loi intitulée « An Act respecting Transfer of the Assets and Liabilities of The Community Chest of Greater Winnipeg to the United Way of Greater Winnipeg and to repeal the Acts of Incorporation of The Community Chest of Greater Winnipeg » sanctionnée le 27 avril 1966;
ATTENDU QUE la loi intitulée « An Act to incorporate United Way of Greater Winnipeg » a été par la suite modifiée de façon à changer le nom de la corporation pour « Centraide Winnipeg » (ci-après appelée « Centraide ») et que la Loi a été adoptée de nouveau sous le nom de Loi constituant en corporation Centraide Winnipeg;
ATTENDU QUE le ministre de la Justice a fait rédiger la présente loi en français et en anglais en vue de sa réadoption en conformité avec un jugement et une ordonnance de la Cour suprême du Canada datés respectivement du 13 juin 1985 et du 4 novembre 1985;
THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definition of "donation"
1 In this Act, "donation" means any gift, grant, legacy, devise, or bequest, of real or personal property, or both, of every nature and wheresoever situated and includes a grant, bequest, or devise, given by trust, will, or other testamentary document.

Assets and liabilities
2 All assets and liabilities of every description belonging to, or standing in the name of, the chest, as of October 15, 1965, are transferred to, vested in, and charged upon united way.
Actif et passif
2 L'actif et le passif de tout genre qui appartiennent à la Caisse ou qui sont à son nom le 15 octobre 1965 sont dévolus à Centraide.
Donations
3 Any donation made to the chest heretofore or hereafter shall be conclusively deemed to be a donation to united way as if united way was in fact named therein in place and stead of the chest.
Dons
3 Tout don fait à la Caisse avant ou après l'entrée en vigueur de la présente loi est réputé, de façon concluante, un don à Centraide comme si Centraide y était en fait nommé en lieu et place de la Caisse.
