HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
THE COAT OF ARMS, EMBLEMS AND THE MANITOBA TARTAN ACT
The Coat of Arms, Emblems and the Manitoba Tartan Act is amended by this section.
The title is replaced with "THE MANITOBA EMBLEMS ACT".
The following is added after section 4:

This Act may be referred to as chapter E72 of the Continuing Consolidation of the Statutes of Manitoba.
The Schedule to The Provincial Flag Act is added as Schedule C to The Coat of Arms, Emblems and the Manitoba Tartan Act as amended by this Act.
THE CONSUMER PROTECTION ACT
The French version of The Consumer Protection Act is amended by this section.
Section 97.3 is amended, in the part before clause (a), by adding ", prendre des mesures concernant les sanctions administratives pouvant être imposées relativement à des contraventions à la présente loi et aux règlements, y compris" after "règlement".
Subsection 136(1) is amended by striking out "ministre" and substituting "directeur".
THE COOPERATIVES ACT

THE CREDIT UNIONS AND CAISSES POPULAIRES AMENDMENT ACT
Conditional amendment — S.M. 2021, c. 24
This section applies if this Act receives royal assent before The Credit Unions and Caisses Populaires Amendment Act, S.M. 2021, c. 24, comes into force.
Subsection 2(2) of The Credit Unions and Caisses Populaires Amendment Act , S.M. 2021, c. 24, is replaced with the following:

The Deer Lodge Curling Club Limited Incorporation Act, R.S.M. 1990, c. 45, is repealed.
THE DRIVERS AND VEHICLES ACT
The French version of The Drivers and Vehicles Act is amended by this section.
Subsection 1(1) is amended
(a) by repealing the definition "État"; and
(b) by adding the following definition:

The Early Learning and Child Care Act, as enacted by S.M. 2021, c. 41, is amended by this section.
Section 8 of the French version is amended by striking out "plus d'un enfant en bas âge ou d'âge préscolaire" and substituting "au moins un enfant en bas âge ou d'âge préscolaire dans un centre".
Subsection 16(1) is amended by striking out "The Civil Service Act" and substituting "Part 3 of The Public Service Act".
Subsection 44(2) of the English version is amended by striking out "14 days of" and substituting "14 days after".
THE ELECTIONS ACT
The French version of The Elections Act is amended by this section.
Clause 5(b) is amended by striking out "au moins" and substituting "plus de".

THE EMERGENCY MEASURES ACT

The English version of The Employment Standards Code is amended in subsection 60(3.1)
(a) by striking out "or" at the end of clause (e); and

THE FAIR REGISTRATION PRACTICES IN
REGULATED PROFESSIONS ACT
Item 17 of the Schedule to The Fair Registration Practices in Regulated Professions Act is amended by striking out "The Manitoba Pharmaceutical Association" and substituting "College of Pharmacists of Manitoba".
THE FINANCIAL ADMINISTRATION ACT
The Financial Administration Act is amended by this section.
Subsection 12(1) of the French version is amended in the section heading by striking out "pouvoirs" and substituting "attributions".
The heading for Part 8 is replaced with "REVENUE OFFICERS".
THE PROVINCIAL FLAG ACT
The Provincial Flag Act is repealed.
THE FREEDOM OF INFORMATION AND
PROTECTION OF PRIVACY ACT
Subsection 59(4) of The Freedom of Information and Protection of Privacy Act is amended by replacing the section heading with "Complaint about refusal".
THE HEALTH CARE DIRECTIVES ACT
The following provisions of The Health Care Directives Act are amended by adding "or common-law partner" after "spouse":

THE HIGHWAY TRAFFIC ACT
The French version of The Highway Traffic Act is amended by this section.

The French version of The Local Government Districts Act is amended by this section.
The part of clause 9(1)(j) after subclause (iv) and before subclause (v) is amended by striking out "de taxe de vente, des demandes relatives à la taxe de vente" and substituting "ou des demandes de vente pour défaut de paiement de taxes".

THE MINOR AMENDMENTS AND CORRECTIONS ACT, 2020
The Minor Amendments and Corrections Act, 2020, S.M. 2021, c. 4, is amended by this section.
Subsection 6(4) of the French version, insofar as it amends subsection 75(2) of The Child and Family Services Act, is replaced with the following:

Clause 22(1)(a) of the French version of The Municipal Assessment Act is amended by striking out "tenus" and substituting "détenus".

Subsection 10.1(4) of the English version of The Personal Health Information Act is amended by striking out "applicant" wherever it occurs and substituting "individual".

THE TEACHERS' PENSIONS ACT

THE THOMPSON CHARTER
Section 2 of The Thompson Charter, S.M. 1989-90, c. 83, is amended by repealing the definition "council".
THE TRANSPORTATION INFRASTRUCTURE ACT
The Transportation Infrastructure Act is amended by adding the following after section 28:
If land adjacent to a departmental road is connected to a departmental road by means of an access, the owner of the adjacent land is responsible for maintaining and repairing the access and must keep it in a reasonable state of repair.
Maintenance of access to other highway
If a highway other than a departmental road is connected to a departmental road by means of an access, the traffic authority responsible for the highway is responsible for maintaining and repairing the access and must keep it in a reasonable state of repair.
Meaning of "traffic authority"
In subsection (2), "traffic authority" means a traffic authority as defined in The Highway Traffic Act.
THE VITAL STATISTICS ACT
Subsection 3(14) of The Vital Statistics Act is amended by striking out "subsection 24.7(1)" and substituting "subsection 24.8(1)".
THE WORKERS COMPENSATION ACT
The Workers Compensation Act is amended by this section.
Subsection 60.5(2) is amended by striking out "clause 60.2(1)(a)" and substituting "clause 60.2(1)(c)".
Clause 73(2)(b) and section 76.2 are amended by striking out "self-insured employers" wherever it occurs and substituting "individually assessed employers", with necessary grammatical changes.
Subsection 76.3(2) is amended
(a) in the section heading, by striking out "self-insurers" and substituting "individually assessed employers"; and
(b) by striking out "self-insured employers" and substituting "individually assessed employers".
Clause 76.4(b) is amended by striking out "self-insured employers" and substituting "individually assessed employers".
Subsection 80(2) is replaced with the following:
Every employer within the scope of this Part must keep a record of the wages earned by its employees, showing the name of each worker, the dates and time worked and the wages earned, and furnish the record to the board upon request within the time period prescribed by regulation.
The following is added after subsection 80(3):
A payroll return, record of wages or statement required by the board under subsections (1) to (3) is deemed to be furnished on the day it is received by the board.
Subsection 80.1(5) is amended by striking out "subsection 86(2)" and substituting "subsection 86(1)".
Subsection 81(1.1) is amended by striking out "self-insured employers" and substituting "individually assessed employers".
The following is added after clause 117(g):
(g.1) for the purpose of subsection 80(2), prescribing the time limits for retention of records of wages by an employer and for delivery of records of wages requested by the board;
(g.2) for the purpose of subsection 80(3), prescribing the time limit for delivery of a statement requested by the board;
COMING INTO FORCE
Subject to this section, this Act comes into force on the day it receives royal assent.
If section 5 applies, subsection 5(2) is deemed to come into force immediately after The Credit Unions and Caisses Populaires Amendment Act, S.M. 2021, c. 24, comes into force.
Section 23 is deemed to have come into force on May 12, 2021.

The English version of The Red River College Act is amended by this section.
The title is replaced with "THE RED RIVER COLLEGE POLYTECHNIC ACT".
The second, third and fourth paragraphs of the preamble are amended by striking out "College" wherever it occurs and substituting "College Polytechnic".

(a) by replacing the section heading with "Red River College Polytechnic Council"; and
(b) by striking out "a college council" and substituting "the Red River College Polytechnic Council".
Subsection 21(2) is amended by striking out "college".
Subsection 21(3) is replaced with the following:
The purpose of the council is to provide a means through which Red River College Polytechnic's staff and students may advise the board on academic and other matters and to
(a) promote the exchange of information and ideas between Red River College Polytechnic and the staff and students;
(b) consider ways of improving the delivery of programs and services by Red River College Polytechnic to the public;
(c) consider Red River College Polytechnic policies as they affect staff and students; and
(d) consider methods to improve the operation of the Red River College Polytechnic.
Subsections 21(4) to (6) are amended by striking out "college" wherever it occurs.
Section 22 is amended
(a) by striking out "College" wherever it occurs and substituting "College Polytechnic"; and
(b) in clauses (2)(a) and (b), by striking out "the college" and substituting "Red River College Polytechnic".
Section 41 is amended
(a) by striking out "College" wherever it occurs and substituting "College Polytechnic", with necessary grammatical changes; and
(b) in clause (1)(e), by striking out "college council" and substituting "Red River College Polytechnic Council".
Subsection 43(5) is amended by striking out "of the college".
