The Statutes Correction and Minor Amendments Act, 2005

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
THE ANATOMY ACT
The Anatomy Act is amended by this section.
Subsection 4(4) is amended by striking out "The Human Tissue Act" and substituting "The Human Tissue Gift Act".
Section 26 is amended
(a) in the section heading, by striking out "Human Tissue Act" and substituting "Human Tissue Gift Act"; and
(b) by striking out "The Human Tissue Act" and substituting "The Human Tissue Gift Act".
THE CHANGE OF NAME ACT
The Change of Name Act is amended by this section.
Subsection 1(1) of the French version is amended in the definition "enfant" by striking out "qui vivent ou qui ont vécu dans une relation maritale" and substituting "qui sont ou ont été liés par une union de fait".
Clause 2(1)(c) of the French version is replaced with the following:
c) a été liée par une union de fait;
Clause 2(2)(c.1) of the French version is replaced with the following:
c.1) si l'auteur de la demande est lié par une union de fait, le nom au complet de son conjoint de fait avant que celui-ci ne soit partie à l'union, la date à laquelle cette union a débuté et une mention indiquant si celle-ci est enregistrée ou non dans un autre ressort;
THE CHILD AND FAMILY SERVICES ACT
Subsection 28(1) of the English version of The Child and Family Services Act is amended by striking out "jurisidiction" and substituting "jurisdiction".
THE CHILD CUSTODY ENFORCEMENT ACT
The Schedule of the English version of The Child Custody Enforcement Act is amended in Article 26 by striking out "participation of legal counsel of advisers" and substituting "participation of legal counsel or advisers".
THE COMMON-LAW PARTNERS' PROPERTY AND RELATED AMENDMENTS ACT
The Common-Law Partners' Property and Related Amendments Act, S.M. 2002, c. 48, is amended by this section.
Clauses 28(1)(a) and (g) are repealed.
Subsection 28(2) is replaced with the following:
If, during the 3rd session of the 37th Legislature, Bill 34 entitled The Charter Compliance Act is assented to, then
(a) The Adoption Act;
(b) The Animal Liability Act;
(c) The Consumer Protection Act; and
(d) The Credit Unions and Caisses Populaires Act;
are amended by adding the following as subsection 1(3) of each Act:
Registered common-law relationship
For the purposes of this Act, while they are cohabiting, persons who have registered their common-law relationship under section 13.1 of The Vital Statistics Act are deemed to be cohabiting in a conjugal relationship of some permanence.
THE CREDIT UNIONS AND CAISSES POPULAIRES ACT
Subsection 98(2) of the English version of The Credit Unions and Caisses Populaires Act is amended by striking out "and" at the end of clause (b) and adding "and" at the end of clause (b.1).
THE CROSS-BORDER POLICING ACT
Clause 46(b) of the English version of The Cross-Border Policing Act, S.M. 2004, c. 4, is amended by striking out "investigation" and substituting "investigation,".
THE DEPENDANTS RELIEF ACT
Subsection 18(2) of the English version of The Dependants Relief Act is amended by striking out "a equalization" and substituting "an equalization".
THE ELDERLY AND INFIRM PERSONS' HOUSING ACT
The Elderly and Infirm Persons' Housing Act is amended by this section.
Subsection 17(3) is amended by striking out ", a hostel, or a personal care home," and substituting "or a hostel".
Subsection 27(1) is amended by striking out ", or hostel, or personal care home" and substituting "or a hostel".
Clause 31(k) is amended by striking out ", hostel, or personal care home" and substituting "or a hostel".
THE EMPLOYMENT AND INCOME ASSISTANCE AMENDMENT ACT (ONE-TIER ASSISTANCE FOR RURAL AND NORTHERN MANITOBA)
The Employment and Income Assistance Amendment Act (One-Tier Assistance for Rural and Northern Manitoba), S.M. 2004, c. 2, is amended by this section.
Clause 2(b) of the English version is replaced with the following:
(b) in the definition "applicant", by striking out "income assistance, general assistance or municipal assistance, as the case may be" and substituting "income assistance or general assistance";
(b.1) in the definition "recipient", by striking out "income assistance, general assistance or municipal assistance, as the case may be," and substituting "income assistance or general assistance"; and
Clause 9(2)(c) of the English version is replaced with the following:
(c) by striking out "income assistance, municipal assistance or general assistance" and substituting "income assistance or general assistance".
Clause 15(b) of the English version is replaced with the following:
(b) in clauses (d), (e) and (g), by striking out "income assistance, general assistance or municipal assistance" wherever it occurs and substituting "income assistance or general assistance";
(b.1) in clause (g.3), by striking out "income assistance, municipal assistance or general assistance" and substituting "income assistance or general assistance"; and
THE FAMILY FARM PROTECTION ACT
Subsections 3(15) and (16) of The Family Farm Protection Act are repealed.
THE FAMILY MAINTENANCE ACT
The Family Maintenance Act is amended by this section.
Clause 53(3.3)(b) is replaced with the following:
(b) where the agreement conflicts with the terms of an order, the order prevails for the purposes of this Part, except in respect of the enforcement of
(i) a final order under The Reciprocal Enforcement of Maintenance Orders Act, in which case that Act applies, or
(ii) a support order under The Inter-jurisdictional Support Orders Act, in which case that Act applies.
Clause 55(2.2)(c) is repealed.
The French version of clause 55(4)(d) is amended by striking out "paragraphe 57" and substituting "paragraphe 57(4)".
THE FARM PRODUCTS MARKETING ACT
Clause 34(c) of the English version of The Farm Products Marketing Act is amended by striking out "board of commission" and substituting "board or commission".
THE FATALITY INQUIRIES ACT
Clause 7(2)(b) of The Fatality Inquiries Act is amended by striking out "The Human Tissue Act" and substituting "The Human Tissue Gift Act".
THE FIRES PREVENTION AND EMERGENCY RESPONSE ACT
Section 51 of The Fires Prevention and Emergency Response Act is replaced with the following:
Commissioner's authority to arrest
The fire commissioner has the authority and jurisdiction of a peace officer for the arrest of a person disturbing the peace or stealing property at a fire.
THE FLIN FLON EXTENSION OF BOUNDARIES ACT
Subclause 4(k)(ii) of The Flin Flon Extension of Boundaries Act, S.M. 1989-90, c.73, is amended by striking out "magistrate" wherever it occurs and substituting "justice of the peace".
THE FLOODWAY AUTHORITY ACT
The Floodway Authority Act is amended by this section.
The title is replaced with "THE MANITOBA FLOODWAY AUTHORITY ACT".
"Floodway Authority" is struck out wherever it occurs and "Manitoba Floodway Authority" is substituted.
Subsection 5(1) of the English version is amended by striking out "Floodway Authority's" and substituting "Manitoba Floodway Authority's".
THE FORTIFIED BUILDINGS ACT
The definition "director" in subsection 1(1) of The Fortified Buildings Act is replaced with the following:
"director" means the person appointed under The Civil Service Act as the director for the purpose of this Act; (« directeur »)
THE GAMING CONTROL AMENDMENT ACT
Subsection 13(3) of the French version of The Gaming Control Amendment Act, S.M. 2004, c.6, is amended by striking out "de licence, d'inscription ou d'enregistrement" and substituting "de la licence, de l'inscription ou de l'enregistrement accordé".
THE HEALTH SERVICES INSURANCE ACT
Subsection 2(1) of The Health Services Insurance Act is amended in clause (c) of the definition "dependant" by striking out "18 years of age or older but not more than two years older than 18 years of age," and substituting "between 18 and 20 years of age,".
THE HUMAN TISSUE GIFT ACT
The Human Tissue Gift Act is amended by this section.
Section 1 is amended by adding the following definition:
"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act; (« ministre »)
Subsection 15(3.1) of the English version is amended by striking out "Nothing is" and substituting "Nothing in".
THE INSURANCE ACT
The Insurance Act is amended by this section.
The section heading for subsection 33(1) of the French version is amended by striking out "Etat" and substituting "État".
The section headings for subsection 84(1) and section 87 of the French version are amended by striking out "Etats" and substituting "États".
Section 242 of the French version is amended by striking out "Etats-Unis" and substituting "États-Unis".
THE MENTAL HEALTH ACT
The definition "enduring power of attorney" in section 1 of the English version of The Mental Health Act is amended by striking out "Atttorney" and substituting "Attorney".
THE MUNICIPAL ACT
Clause 49(b) of the French version of The Municipal Act is amended by striking out "28 et 29" and substituting "30 et 31".
THE MUSEUMS AND MISCELLANEOUS GRANTS ACT
The Museums and Miscellaneous Grants Act is repealed.
THE OFF-ROAD VEHICLES ACT
The definition "ministre" in subsection 1(1) of the French version of The Off-Road Vehicles Act is amended by striking out "menbre" and substituting "membre".
THE PARI-MUTUEL LEVY ACT
Subsection 10(2) of The Pari-Mutuel Levy Act is amended by striking out "section 37" and substituting "subsection 33(2)".
THE PERSONAL HEALTH INFORMATION ACT
The definition "santé" in subsection 1(1) of the French version of The Personal Health Information Act is amended by striking out "un esprit, un corps et un moral" and substituting "une spiritualité, un esprit et un corps".
THE PETTY TRESPASSES ACT
Subsection 1(1) of The Petty Trespasses Act is amended by striking out "$25" and substituting "$5,000".
THE PHARMACEUTICAL ACT
The Pharmaceutical Act is amended by this section.
The definition "prescription" in section 1 is amended by striking out "dentist or veterinary surgeon" and substituting "dentist, veterinary surgeon, midwife or registered nurse (extended practice)".
The following is added after clause 2(2)(f):
(g) prevents a registered nurse (extended practice) from prescribing or administering a drug if he or she is permitted to do so under The Registered Nurses Act.
THE MANITOBA PUBLIC INSURANCE CORPORATION ACT
Clause 39(5)(d) of the English version of The Manitoba Public Insurance Corporation Act is amended by striking out "trail" and substituting "trial".
THE PUBLIC SCHOOLS ACT
The Public Schools Act is amended by this section.
Subsection 92(4) is amended in the part before clause (a) by striking out "an approved form of" and substituting "a prescribed".
The definition "teacher" in subsection 97(1) is amended by striking out "in Form 2 of Schedule D or in any other form approved by the minister" and substituting "prescribed".
Form 2 of Schedule D is repealed.
THE PUBLIC UTILITIES BOARD ACT
The Public Utilities Board Act is amended by this section.
Subsection 109(1) is amended by replacing everything before clause (a) with the following:
Within two months after the end of each fiscal year, the board must make a report to the minister on its activities during that fiscal year. The report must include
Subsection 109(2) is replaced with the following:
Tabling of reports in the Assembly
The minister must table a copy of the report in the Assembly within 15 days after receiving it if the Assembly is sitting or, if it is not, within 15 days after the next sitting begins.
In this section, "fiscal year" has the same meaning as in section 1 of The Financial Administration Act.
Transition: 2004 annual report
The report for the fiscal year ending March 31, 2005 must include the matters described in clauses 109(1)(a) to (d) for the period January 1, 2004 to March 31, 2005.
THE REAL PROPERTY ACT
Subsection 1(1) of the French version of The Real Property Act is renumbered as section 1.
THE RESIDENTIAL TENANCIES ACT
The Residential Tenancies Act is amended by this section.
Clause 96(1)(a) of the French version is amended by striking out "20(1),".
Subsection 106.1(3) of the French version is amended by striking out "qui n'ont aucune valeur monétaire et qui ne peuvent être entreposés pour des raisons sanitaires ou de sécurité" and substituting "qui ont une valeur monétaire et dont l'entreposage ne cause pas de problèmes sanitaires ou de sécurité".
THE SAFER COMMUNITIES AND NEIGHBOURHOODS ACT
The definition "director" in subsection 1(1) of The Safer Communities and Neighbourhoods Act is replaced with the following:
"director" means the person appointed under The Civil Service Act as the director for the purpose of this Act; (« directeur »)
THE NON-SMOKERS HEALTH PROTECTION ACT
Section 10 of The Non-Smokers Health Protection Act is amended by striking out "S125" and substituting "N92".
THE VICTIMS' BILL OF RIGHTS
The Victims' Bill of Rights is amended by striking out "Director of Victims' Support Services" and replacing it with "Director of Victim Services" in the following provisions:
(a) section 27;
(b) the definition "director" in section 38;
(c) subsection 39(1).
THE VITAL STATISTICS ACT
Clause 48(a) of the French version of The Vital Statistics Act is amended by striking out "elle doivent" and substituting "elles doivent".
THE WATER RESOURCES ADMINISTRATION ACT
Section 2.1 of The Water Resources Administration Act is amended
(a) by striking out "the Floodway Authority established" and substituting "the Manitoba Floodway Authority established"; and
(b) by striking out "The Floodway Authority Act" and substituting "The Manitoba Floodway Authority Act".
COMING INTO FORCE
This Act, except sections 5, 7, 10, 17, 19, 25 and 33, comes into force on the day it receives royal assent.
Section 5 is deemed to have come into force on June 30, 2004.
Section 7 is deemed to have come into force on November 19, 2004.
Section 10 is deemed to have come into force on June 1, 2004.
Section 17 is deemed to have come into force on November 1, 2004.
Section 19 is deemed to have come into force on April 15, 2005.
Section 25 comes into force on January 1, 2006.
Section 33 is deemed to have come into force on February 28, 2005.
