THE STATUTE LAW AMENDMENT ACT, 1996
(Assented to November 19, 1996)
HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
GENERAL
THE AGRICULTURAL PRODUCERS' ORGANIZATION FUNDING ACT
The Agricultural Producers' Organization Funding Act is amended by this section.
Clause 12(1)(c) of the English version is amended by striking out "and".
Subsection 37(2) is amended by striking out "clause 33(2)(e)" and substituting "subsection 34(1)".
THE BUSINESS PRACTICES ACT
Subsection 9(2) of The Business Practices Act, as enacted by S.M. 1990-91, c.6, is repealed.
THE CHIROPRACTIC ACT
Clause 4(e) of The Chiropractic Act is amended by striking out "Canadian and British Insurance Companies Act (Canada)" and substituting "Insurance Companies Act (Canada)".
THE CONSERVATION DISTRICTS ACT
C.C.S.M. c. C175 - validation of regulations
The following Orders in Council made under The Conservation Districts Act are validated and declared to have been lawfully made:
(a) Order in Council 1094/89, respecting the establishment of The Pembina Valley Conservation District;
(b) Order in Council 39/1995, respecting the establishment of The West Souris River Conservation District;
(c) Order in Council 874/1994, adding provisions applicable to The Turtle Mountain Conservation District No. 4;
and everything done under the authority of those orders in council that would have been valid had this section been in force at the time is validated and deemed to have been lawfully done.
THE CONSUMER PROTECTION ACT
Sections 118 and 119 of The Consumer Protection Act, as enacted by R.S.M. 1987, c. C200, are repealed.
Section 120 of The Consumer Protection Act is repealed.
THE DENTAL ASSOCIATION ACT
Clause 5(g) of The Dental Association Act is amended by striking out "Canadian and British Insurance Companies Act (Canada)" and substituting "Insurance Companies Act (Canada)".
THE FAMILY MAINTENANCE ACT
The Family Maintenance Act is amended by this section.
Section 16 is amended in the part preceding clause (a) by striking out "section 24" and substituting "section 23,".
Subsection 49(2) of the English version is amended by striking out "Act," and substituting "Act or".
THE LEGAL AID SERVICES SOCIETY OF MANITOBA ACT
The following provisions of the French version of The Legal Aid Services Society of Manitoba Act are amended by striking out "Société de l'aide juridique" and substituting "Société d'aide juridique":
(a) section 1, in the definition "Société"; and
(b) section 2.
THE NATURAL GAS SUPPLY ACT
Section 28 of The Natural Gas Supply Act, as enacted by S.M. 1987-88, c.65, is repealed.
THE PROCEEDINGS AGAINST THE CROWN ACT
The Proceedings Against the Crown Act is amended by this section.
Section 7 is amended
(a) by renumbering it as subsection 7(1); and
(b) by striking out "All proceedings" and substituting "Subject to subsection (2), all proceedings".
The following is added after subsection 7(1):
Subject to the provisions of The Court of Queen's Bench Small Claims Practices Act, any proceeding against the Crown in the Court of Queen's Bench may be proceeded with in accordance with The Court of Queen's Bench Small Claims Practices Act.
THE MANITOBA PUBLIC INSURANCE CORPORATION ACT
Section 78 of The Manitoba Public Insurance Corporation Act is amended in the part preceding clause (a) by striking out "The Health Services Act" and substituting "The Health Services Insurance Act".
THE REAL PROPERTY ACT
The Real Property Act is amended by this section.
Subsection 14(1) of the English version is amended by striking out "every insrument" and substituting "every instrument".
Subsection 71(2) of the English version is amended by striking out "occassioned" and substituting "occasioned".
Section 86 of the English version is amended in the section heading by striking out "Restrictions or" and substituting "Restrictions on".
Clause 111(1)(i) is amended by adding "cable television, telecommunications," after "telegraph,".
AN ACT TO AMEND THE RELIGIOUS SOCIETIES' LANDS ACT
An Act to amend The Religious Societies' Lands Act, as enacted by S.M. 1987-88, c.35, is repealed.
THE REVENUE ACT
The definition "minister" in subsection 33(1) of The Revenue Act is amended by striking out "Minister of Justice" and substituting "Minister of Consumer and Corporate Affairs".
THE SPECIAL SURVEY ACT
In the following provisions of The Special Survey Act", "Minister of Justice" is struck out and "Minister of Consumer and Corporate Affairs" is substituted:
(a) the part of section 1 that precedes clause (a);
(b) section 3, in the part that precedes clause (a) and in clause (a) wherever it occurs;
(c) section 4 wherever it occurs;
(d) section 5;
(e) section 6, in the section heading of the English version and wherever it occurs in the section;
(f) in section 7 wherever it occurs;
(g) in section 9.
THE SUMMARY CONVICTIONS ACT
Subsection 16(5) of The Summary Convictions Act is amended by striking out "within 5 days after the date of the offence notice" and substituting ", prior to the first appearance date indicated on the offence notice,".
RE-ENACTED STATUTES - PRIVATE ACTS
THE ROMAN CATHOLIC ARCHIEPISCOPAL CORPORATION OF WINNIPEG AND THE ROMAN CATHOLIC ARCHDIOCESE OF WINNIPEG ACT
Section 10 of The Roman Catholic Archiepiscopal Corporation of Winnipeg and the Roman Catholic Archdiocese of Winnipeg Act, R.S.M. 1990, c. 150, is amended by striking out "section 8" and substituting "section 9".
COMING INTO FORCE
Subject to subsections (2) to (5), this Act comes into force on the day it receives royal assent.
Coming into force of sections 3 and 7
Sections 3 and 7 are retroactive and are deemed to have come into force on June 1, 1992.
Coming into force of section 4
Section 4 is retroactive and is deemed to have come into force on September 6, 1995.
Coming into force of sections 15 and 16
Sections 15 and 16 are retroactive and are deemed to have come into force on April 1, 1996.
Coming into force of section 18
Section 18 is retroactive and is deemed to have come into force on November 1, 1990.
