The Highway Traffic Amendment Act

(Assented to June 24, 1992)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Highway Traffic Act is amended by this Act.

Subsection 5(18) is repealed and the following is substituted:

Exemption from registration fee

5(18)

Notwithstanding any provision of this Act, a person who, while on active service

(a) as a member of the armed services of Canada; or

(b) during wartime as a member of the armed forces of an ally of Canada;

lost a limb, was rendered a paraplegic or quadriplegic or was blinded, is exempt from the registration fee payable under this Act in respect of one motor vehicle owned by the person if he or she uses it solely for pleasure and does not derive any financial profit from its use.

Subsection 186(5) is amended by striking out "or" at the end of clause (g), by adding "or" at the end of clause (h) and by adding the following after clause (h):

(i) who is in the care or custody of a peace officer.

Subsection 318.7(1) is amended by striking out "vehicle maintenance standards" wherever it occurs and substituting "standards of safety and repair applicable to that vehicle".

Subsection 319(1) is amended

(a) by repealing clause (jj); and

(b) by repealing clause (sss) and by substituting the following:

(sss) prescribing the classes or types of vehicles to be inspected, the time or times when a vehicle is required to be inspected, the form of inspection certificate and decal evidencing compliance with vehicle safety and repair standards, the persons authorized to issue certificates and to affix and remove decals and the fees payable in respect of inspection certificates and decals;

(c) by repealing subclause (ttt)(iii).

5(2)

The following is added after subsection 319(1):

Regulations by registrar

319(1.1)

The registrar may by regulation prescribe

(a) standards of safety and repair of vehicles and parts of vehicles for the purposes of this Act and the regulations; and

(b) inspection procedures and criteria for determining compliance with the standards of safety and repair.

Coming into force

6(1)

Subject to subsection (2), this Act comes into force on the day it receives royal assent.

Coming into force: sections 4 and 5

6(2)

Sections 4 and 5 come into force three months after the day this Act receives royal assent.
