This regulation is made under the Manitoba Egg and Pullet Producers' Marketing Plan Regulation, Man. Reg. 242/87 R and is Regulation 3/89 of The Manitoba Egg Producers' Marketing Board.

Registered producers

1   A levy is imposed on every person to whom this Board has allotted a pullet production quota, of $2.00 per pullet raised or kept by him in Manitoba at any time in any week in excess of the maximum number of pullets that such person has been authorized by this Board to raise or keep at any point in time during all or a portion of his production year as indicated on his Pullet Rearing Certificate.

Non-registered producers

2(1)   A levy is imposed on every person who raises or keeps pullets in Manitoba and who has not been allotted a pullet production quota by this Board of $2.00 per pullet raised or kept by him in Manitoba at any time in any week in excess of 299 pullets.

2(2)   The levy imposed under subsection (1) shall not apply to a person who raises or keeps laying hens and who, in such capacity, has been designated by this Board as a designated small non-registered producer, or as a designated multi-family non-registered producer, for such period of time that such designation is in effect.

Designated small non-registered producer

3(1)   A levy is imposed on every person who

(a) raises or keeps pullets in Manitoba and

(b) raises or keeps laying hens and

(c) who, in such capacity, has been designated by this Board as a designated small non-registered producer,

of $2.00 per pullet raised or kept by him in Manitoba at any time in any week in excess of such producer's verified number of laying hens.

3(2)   For the purpose of this section 3;

"designated small non-registered producer" means a person who is currently designated as a designated small non-registered producer by this Board pursuant to Manitoba Regulation 268/88;

"verified number of laying hens" means such producer's verified number of laying hens pursuant to Manitoba Regulation 268/88.

Designated multi-family non-registered producers

4(1)   A levy is imposed on every person who

(a) raises or keeps pullets in Manitoba and

(b) raises or keeps laying hens and

(c) who, in such capacity, has been designated by this Board as a designated multi-family non-registered producer,

of $2.00 per pullet raised or kept by such multi-family non-registered producer in Manitoba at any time in any week in excess of 499 laying hens.

4(2)   For the purpose of this section 4 a designated multi-family non-registered producer means an individual currently designated as a designated multi-family non-registered producer by this Board pursuant to Manitoba Regulation 268/88.

Payment of levies

5   The levies imposed under this regulation shall be due and payable to this Board at its office, Suite 18, 5 Scurfield Boulevard, Winnipeg, Manitoba, R3Y 1G3, within 7 days following delivery of notice in writing to such person by this Board of the amount of the levy calculated by this Board to be owing by him to this Board.

Effect of subsection 27(1) of M.R. 70/2005

5.1   This regulation is subject to subsection 27(1) of the Manitoba Egg and Pullet Producers Marketing Plan Regulation, Manitoba Regulation 70/2005.

Application of definitions from M.R. 70/2005

5.2   Terms defined in the Manitoba Egg and Pullet Producers Marketing Plan Regulation, Manitoba Regulation 70/2005, and used in this regulation have the same meaning in this regulation as in that regulation.

Repeal

6   Manitoba Regulation 33/86 is repealed.

Effective date

7   This regulation comes into force on October 1, 1989.
