This Order is made under the Manitoba Turkey Producers Marketing Plan Regulation, Manitoba Regulation 38/2004, and is Order No. 1, 2017 of Manitoba Turkey Producers. |
Minimum price
1 The minimum price at which turkey produced within the province may be sold by any registered producer until further Order of this board is hereby fixed as follows:

Grade
2 The grade of turkey must be established in accordance with the Livestock and Poultry Carcass Grading Regulations made under the Canada Agricultural Products Act.
F.O.B. production premises
3(1) The minimum prices established under section 1 are basis F.O.B. the producer's production premises.
Meaning of F.O.B.
3(2) For the purpose of this section "F.O.B. the producer's production facilities" means that the person purchasing the turkey from the producer must provide a vehicle appropriate for transporting the turkey being purchased and locate such vehicle adjacent to the producer's production facility to accommodate the loading of the turkey from the producer's facility into such vehicle by the producer.
Determination of weight
4 Each purchaser of turkey from a producer must provide the producer with a receipt showing
(a) the number of turkeys removed from the producer's production facility;
(b) the tare and full load weights of the turkey removed from the producer's production facility; and
(c) the location of the scale used to determine the weights referred to in clause (b) and the date and time the weights were determined.
Payment
5 The payment for all turkey purchased from a producer must be made by the purchaser within seven days following removal of the turkey from the producer's production facilities unless otherwise agreed to by the producer.
Non-application to poults
6 This Order does not apply to the marketing of turkeys less than 10 days old.
Non-application to matures
7 This Order does not apply to the marketing of turkey of 28 weeks of age or older.
Applications of definitions from M.R. 38/2004
8 Terms defined in the Manitoba Turkey Producers Marketing Plan Regulation, Manitoba Regulation 38/2004, and used in this Order, have the same meaning in this Order as in that Manitoba Government regulation.
Repeal
9 The Turkey Price Order No. 3, 1997, Manitoba Regulation 252/97, is repealed.
Coming into force
10 This Order comes into force on July 18, 2017, or on the day it is registered under The Statutes and Regulations Act, whichever is later.
