This Regulation is made under the Canadian Turkey Marketing Agency Delegation Regulation, Manitoba Regulation 184/2000, and is Regulation No. 1, 2016 of the Turkey Farmers of Canada.

Definitions

1   The following definitions apply in this regulation.

"agency" means Turkey Farmers of Canada.

"board" means Manitoba Turkey Producers.

"processor" means any person engaged in the business of processing turkey, or using turkey in manufacturing within Manitoba.

"producer" means a person engaged in the production and marketing of turkey locally within Manitoba.

"turkey" means a turkey of any variety, grade or class.

Levy imposed on producers

2   A levy is imposed on each producer of $0.0305 per kilogram (live weight) of turkey marketed by the producer locally within Manitoba.

Due date of levy

3   A levy imposed under this regulation is due and payable by the producer to the agency at the time and place of the marketing of the turkey by the producer.

Appointment of agent

4   The agency appoints the board as its agent for the purpose of collecting the levies imposed under this regulation.

Processor's obligation to deduct and to remit

5   Each processor must at the time it takes delivery of turkey deduct from the monies payable for the turkey all levies payable by the producer to the agency and must forward the levies to the board at its office, 895B Century Street, Winnipeg, MB, R3H 0M3, not later than seven days after the last day of each week in which the turkey was received.

Producer's obligations to remit if not deducted

6   Each producer must forward to the board at its office, 895B Century Street, Winnipeg, MB, R3H 0M3, all levies payable by the producer under this regulation for turkey marketed by the producer in any week that were not deducted and forwarded to the board by the person who received the turkey from the producer, not later than seven days after the last day of the week in which the turkey was marketed.

Non-application

7   The levies imposed under this regulation do not apply to a person who has provided the agency with a satisfactory undertaking that he or she will market fewer than 100 turkeys in a calendar year, provided that the person markets fewer than 100 turkeys in that year.

Repeal

8   The Canadian Turkey Marketing Agency Levies Regulation for Manitoba, Manitoba Regulation 101/2003, is repealed.
