Manitoba Regulation 290/88 R amended

1 The Automobile Insurance Coverage Regulation, Manitoba Regulation 290/88 R, is amended by this regulation.

1 Le présent règlement modifie le Règlement sur l'assurance automobile, R.M. 290/88 R.

2 Section 87 is amended

(a) by replacing clause (a) with the following:

(a) while they are under the influence of intoxicating liquor or drugs to such an extent as to be, for the time being, incapable of the proper control of the insured vehicle;

(a.1) while they are in a condition for which they are convicted of an offence under subsection 320.14(1), (2) or (3) of the Criminal Code (Canada);

(a.2) while they are not for the time being qualified and authorized by law to drive or operate the vehicle or, if the law does not prescribe any qualification, while under the age of 16 years;

(b) in the English version,

(i) by replacing clause (b) with the following:

(b) while their licence to drive or operate that vehicle is suspended, or while their right to obtain a licence is suspended, or while they are prohibited, under order of any court, from driving or operating that vehicle;

(ii) by striking out "or" at the end of clause (e), and

(iii) in clause (f),

(A) by striking out "him or her" and substituting "them", and

(B) by adding "or" at the end.

2 L'article 87 est modifié :

a) par substitution, à l'alinéa a), de ce qui suit :

a) il est sous l'effet de boissons ou de substances enivrantes à un tel point qu'il est incapable à ce moment d'exercer une maîtrise adéquate du véhicule assuré;

a.1) il est dans un état pour lequel il est déclaré coupable d'une infraction au paragraphe 320.14(1), (2) ou (3) du Code criminel (Canada);

a.2) il n'a pas qualité en vertu de la loi pour conduire ou utiliser le véhicule ou, si la loi ne prescrit aucune exigence, il a moins de 16 ans;

b) dans la version anglaise :

(i) par substitution, à l'alinéa b), de ce qui suit :

(ii) par suppression, à la fin de l'alinéa e), de « or »,

(iii) dans l'alinéa f) :

(A) par substitution, à « him or her », de « them »,

(B) par adjonction, à la fin, de « or ».

Coming into force

3 This regulation comes into force on August 1, 2023, or the day it is registered under The Statutes and Regulations Act, whichever is later.

3 Le présent règlement entre en vigueur le 1^er août 2023 ou le jour de son enregistrement en vertu de la Loi sur les textes législatifs et réglementaires, si cette date est postérieure.
