THE EMPLOYMENT STANDARDS CODE AMENDMENT ACT

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. E110 amended

1   The Employment Standards Code is amended by this Act.

2(1)   Subsection 59.10(1) is amended by striking out "17 weeks" and substituting "27 weeks".

2(2)   Subsection 59.10(6) is amended

(a) by striking out "17 weeks" and substituting "27 weeks"; and

(b) in the English version, by striking out "he or she" and substituting "the employee".

Transitional — employee on or has requested leave

3(1)   If, on the day this Act comes into force, an employee is on leave for serious injury or illness under subsection 59.10(1) of the former Act, or has given their employer notice under subsection 59.10(3) of the former Act but has not yet begun the leave, then the leave to which the employee is entitled is increased from a total of up to 17 weeks to a total of up to 27 weeks.

Meaning of "former Act"

3(2)   In subsection (1), "former Act" means The Employment Standards Code as it read immediately before the coming into force of this Act.

Coming into force

4   This Act comes into force on the day it receives royal assent.

Explanatory Note

The Employment Standards Code is amended to extend the length of the leave for serious injury or illness from 17 weeks to 27 weeks.
