THE PUBLIC SCHOOLS AMENDMENT ACT

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. P250 amended

1   The Public Schools Act is amended by this Act.

2   Subsection 1(1) is amended in the definition "resident pupil"

(a) by replacing the part before clause (a) of the French version with the following:

« élève résident » Élève d'une division ou d'un district scolaire, selon le cas :

(b) by replacing clause (a) with the following:

(a) who resides with their parent or legal guardian who is a resident in the school division or school district if the parent or legal guardian

(i) is a Canadian citizen or permanent resident as defined in the Immigration and Refugee Protection Act (Canada),

(ii) is a member of a visiting force under the Visiting Forces Act (Canada), or

(iii) holds a work or study permit under the Immigration and Refugee Protection Act (Canada), or

(a.1) who becomes a resident in the school division or school district by reason of living with a responsible adult who is not their parent or legal guardian if their parent or legal guardian is a Canadian citizen or permanent resident as defined in the Immigration and Refugee Protection Act (Canada) and resides in Canada, or

(a.2) who or whose parent or legal guardian is claiming refugee protection or has had the protection conferred to them under the Immigration and Refugee Protection Act (Canada), or

3   Clause 1.1(a) is amended

(a) in subclause (i), by striking out "seven" and substituting "six"; and

(b) in subclause (ii),

(i) by striking out "six" and substituting "five", and

(ii) by striking out "seven" and substituting "six".

4   Subsection 259(1) is amended, in the part before clause (a), by striking out "six" and substituting "five".

Coming into force — July 1, 2024

5(1)   Subject to subsection (2), this Act comes into force on July 1, 2024.

Coming into force — July 1, 2025

5(2)   Sections 3 and 4 come into force on July 1, 2025.

Explanatory Note

The Public Schools Act is amended to expand who is considered to be a resident pupil to include the following:

a pupil who lives with a parent or guardian who is a member of a visiting force or who holds a work or study permit;

a pupil who lives with a responsible adult who is not their parent or legal guardian;

a pupil who is a refugee or a child of a refugee.

Beginning in the 2025-2026 school year, the compulsory school age is lowered from seven to six. The age at which a child has the right to attend school is lowered from six to five.
