THE PUBLIC HEALTH AMENDMENT ACT

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

1   The Public Health Act is amended by this Act.

2(1)   Subsection 14(2) is amended by striking out "After consulting with the minister, the" and substituting "The".

2(2)   The following is added after subsection 14(2):

Recommendations re public health matters

14(3)   For certainty, the chief public health officer may include in a report under subsection (2) recommendations concerning any urgent or emergent public health matter.

Report containing recommendations

14(4)   If a report under subsection (2) contains recommendations,

(a) the chief public health officer must give a copy of the report to the minister; and

(b) the minister must table a copy of the report in the Assembly within 15 days after receiving it if the Assembly is sitting or, if it is not, within 15 days after the next sitting begins.

Referral to Standing Committee

14(5)   A report that contains recommendations stands referred to the Standing Committee of the Assembly on Social and Economic Development. The Standing Committee must begin considering it within 60 days after it is tabled in the Assembly.

Coming into force

3   This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Public Health Act.

When the chief public health officer makes recommendations in a report concerning an urgent or emergent public health matter, the minister must table the report in the Assembly, and the Standing Committee on Social and Economic Development must begin consideration of the report within 60 days.
