THE HUMAN RIGHTS CODE AMENDMENT ACT

WHEREAS expressly referencing a learning disability as a form of mental disability within The Human Rights Code may help to protect people with learning disabilities from discrimination and to ensure that their needs are accommodated;

THEREFORE HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

1   The Human Rights Code is amended by this Act.

2   The following is added after subsection 9(2.1):

Learning disability

9(2.2)   For the purpose of clause (2)(l), "mental disability" includes, without limitation, a learning disability.

Coming into force

3   This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Human Rights Code to expressly include a learning disability as a prohibited ground of discrimination.
