THE COMBATIVE SPORTS AMENDMENT ACT

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. C150.3 amended

1   The Combative Sports Act is amended by this Act.

2   Section 1 is amended by adding the following definitions:

"combative sport" means boxing, mixed martial arts or any similar sport prescribed or described by regulation; (« sport de combat »)

"designated amateur combative sport" means an amateur combative sport for which the Lieutenant Governor in Council has designated the commission as the body that must give its permission for a contest in that sport to occur under section 83 of the Criminal Code (Canada); (« sport de combat amateur désigné »)

"inspector" means a person appointed as an inspector under section 23; (« inspecteur »)

3   Section 3 is replaced with the following:

Mandate

3   The commission is responsible for licensing and regulating contests and exhibitions in professional combative sports and designated amateur combative sports in Manitoba.

4   Subsection 9(1) is amended by striking out "professional combative sports" and substituting "professional or designated amateur combative sports".

5   Section 13 is amended by striking out "appointed under this Act".

6(1)   Subsection 14(1) is amended

(a) by striking out "No person" and substituting "Except when permitted by regulation, no person"; and

(b) by striking out "professional combative sports" and substituting "professional or designated amateur combative sports".

6(2)   Subsection 14(1.1) is amended by striking out "The commission" and substituting "Subject to subsection (1.2), the commission".

6(3)   The following is added after subsection 14(1.1):

Exception

14(1.2)   A contestant licence may be issued to a person who is less than 18 years of age if the person is a contestant in a designated amateur combative sport prescribed by regulation.

7   Subsection 15(1) is amended by striking out "professional combative sports" and substituting "professional or designated amateur combative sports".

8   The following is added after subsection 16(1):

Varying rules for minors

16(1.1)   If contestants in a designated amateur combative sports contest or exhibition are less than 18 years of age, the commission may impose terms or conditions on the event permit that require the rules for the contest or exhibition to be modified in a specified manner.

9(1)   Subsection 18(1) is replaced with the following:

Hearings re contraventions of Act

18(1)   The commission may hold a hearing when it has reason to believe that the holder of a licence or event permit has

(a) contravened or permitted the contravention of this Act or the regulations;

(b) engaged in fraud or collusion in relation to a professional or designated amateur combative sports contest or exhibition; or

(c) acted in a manner that is contrary to the public interest.

9(2)   Subsection 18(3) is amended by striking out "registered".

10   Section 19 is replaced with the following:

Interim suspension

19   Before holding a hearing respecting a matter, the commission may, if it considers it to be in the public interest, suspend a licence or event permit until the matter has been determined.

11(1)   Subsection 20(1) is amended

(a) by repealing clause (d);

(b) by adding the following as clause (d.1):

(d.1) prohibit the holder from holding a licence or event permit for a term specified in the order;

(c) in clause (f), by striking out "order" and substituting "require".

11(2)   Subsection 20(3) is amended by striking out "registered".

12(1)   Subsection 22(2) is amended

(a) by striking out "A person" and substituting "Subject to subsection (3), a person"; and

(b) by striking out "professional combative sports" and substituting "professional or designated amateur combative sports".

12(2)   Subsection 22(4) is replaced with the following:

Payment of fees

22(4)   A person who conducts or promotes a professional or designated amateur combative sports contest or exhibition must remit the amount payable under this section to the commission within seven days after the contest or exhibition is held.

13   Section 25 is replaced with the following:

Order stopping contest or event

25(1)   If the commission or an inspector is satisfied that the holder of a licence or event permit has contravened this Act or the regulations, including failing to comply with a term or condition imposed on the holder's licence or event permit, the commission or the inspector may order that the combative sports event or a specific contest or exhibition not be held.

Assistance of peace officers

25(2)   The commission or an inspector may request the assistance of a peace officer when taking action under subsection (1).

14   Subsection 26(1) is amended by striking out "professional combative sports" and substituting "professional or designated amateur combative sports".

15   Clause 29(a) is amended by striking out "under section 18".

16   Clause 30(1)(b) of the English version is amended by striking out "imprisonment for not more than" and substituting "imprisonment for a term of not more than".

17(1)   Subsection 31(1) is amended

(a) by replacing clause (a) with the following:

(a) prescribing or describing one or more sports for the purpose of the definition "combative sport" in section 1;

(a.1) respecting contests and exhibitions in professional and designated amateur combative sports, including

(i) rules governing the conduct of such contests and exhibitions, and

(ii) requirements for contestants, officials and others in such contests and exhibitions;

(b) by adding the following after clause (b):

(b.1) specifying the circumstances when a person does not require a licence;

(b.2) prescribing designated amateur combative sports in which contestant licences may be issued to persons less than 18 years of age;

(c) in clauses (f) and (g), by striking out "professional combative sports" and substituting "professional and designated amateur combative sports";

(d) by repealing clause (h);

(e) in clause (j), by striking out "professional combative sports" and substituting "professional and designated amateur combative sports";

(f) in clause (k),

(i) by striking out "professional" before "contestants", and

(ii) by striking out "professional combative sports";

(g) in clause (l), by striking out "professional";

(h) by adding the following after clause (m):

(m.1) respecting the payment of officials in connection with designated amateur combative sports contests and exhibitions;

(i) by repealing clause (n).

17(2)   Subsection 31(1.1) is repealed.

Coming into force

18   This Act comes into force on a day to be fixed by proclamation.

Explanatory Note

This Bill amends The Combative Sports Act.

Currently, the Manitoba Combative Sports Commission is responsible for licensing and regulating professional combative sports.

This Bill expands the Commission's mandate to include licensing and regulating amateur combative sports that the Lieutenant Governor in Council has designated.

Other minor amendments are made to the Act.
