THE WILDLIFE AMENDMENT ACT

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. W130 amended

1   The Wildlife Act is amended by this Act.

2   Section 1 is amended

(a) by repealing the definitions "foreign resident", "non-resident" and "resident"; and

(b) by adding the following definitions:

"Canadian resident" means a person, other than a Manitoba resident, who is

(a) a Canadian citizen,

(b) a permanent resident within the meaning of the Immigration and Refugee Protection Act (Canada), or

(c) a person whose primary residence is in Canada and who has lived in Canada for at least six consecutive months during the 12-month period immediately before the person applies for a licence or permit under this Act; (« résident du Canada »)

"Manitoba resident" means a person whose primary residence is in Manitoba and who has lived in Manitoba for at least six consecutive months during the 12-month period immediately before the person applies for a licence or permit under this Act; (« résident du Manitoba »)

"non-Canadian resident" means a person who is not a Manitoba resident or a Canadian resident; (« non-résident du Canada »)

3   Section 25 is repealed.

4(1)   Subclause 90(a)(ii) is replaced with the following:

(ii) restricting the issue of permits or licences of any class or type to Manitoba residents, or prescribing separate permits or licences for Manitoba residents, Canadian residents and non-Canadian residents,

4(2)   Clause 90(m) is replaced with the following:

(m) requiring Canadian residents and non-Canadian residents to use the services of guides or outfitters when hunting any species or type of wildlife in all or specified parts of the province or when hunting under a specified type or class of licence;

4(3)   The following is added after clause 90(qq.2):

(qq.3) defining any word or phrase used but not defined in this Act;

Transitional — existing licences

5(1)   On the coming into force of this section,

(a) a person who holds a class or type of resident licence issued under the former Act is deemed to hold the equivalent class or type of Manitoba resident licence;

(b) a person who holds a class or type of non-resident licence issued under the former Act is deemed to hold the equivalent class or type of Canadian resident licence; and

(c) a person who holds a class or type of foreign resident licence issued under the former Act is deemed to hold the equivalent class or type of non-Canadian-resident licence.

Licence continues to be valid

5(2)   Unless it is cancelled or suspended, a licence referred to in subsection (1) issued under the former Act continues to be valid until the licence expires.

Meaning of "former Act"

5(3)   In this section, "former Act" means The Wildlife Act as it read immediately before the coming into force of this Act.

Coming into force — April 1, 2024

6(1)   This Act, except section 3, comes into force on April 1, 2024.

Coming into force — September 1, 2023

6(2)   Section 3 comes into force on September 1, 2023.

Explanatory Note

This Bill amends The Wildlife Act. New residency rules are established for use in issuing licences and permits under the Act. People who reside outside Manitoba may be required to use the services of guides or outfitters when hunting specified animals or when hunting under certain licences. Restrictions on Sunday hunting are removed from the Act.
