THE PHOSPHORUS-FREE DISHWASHING DETERGENT ACT

WHEREAS phosphorus loading of surface waters stimulates the growth of algae, which has adverse environmental, health, and aesthetic effects;

AND WHEREAS significant reductions of phosphorus from laundry detergent have been accomplished, but similar progress in reducing phosphorus contributions from dishwashing detergents has not been achieved;

AND WHEREAS limiting the use of dishwashing detergents containing phosphorus could significantly reduce the discharge of phosphorus into Manitoba's surface and ground waters;

THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definitions

The following definitions apply in this Act.

"dishwashing detergent" means a cleaning agent supplied, sold or manufactured for the purpose of cleaning dishes by hand or by machine. (« détergent à vaisselle »)

"phosphorus" means elemental phosphorus. (« phosphore »)

Detergent containing phosphorus prohibited

No person shall supply, sell or offer for sale, dishwashing detergent containing 0.5% or more phosphorus by weight

(a) for household use, on or after January 1, 2008; and

(b) for commercial use, on or after January 1, 2012.

Offence

A person who contravenes section 2 is guilty of an offence and is liable on summary conviction,

(a) in the case of an individual, to a fine of not more than $5,000.; and

(b) in the case of a corporation, to a fine of not more than $25,000.

This Act may be referred to as chapter P63 of the Continuing Consolidations of the Statutes of Manitoba.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill prohibits the sale of dishwashing detergent containing phosphorus for household use as of January 1, 2008, and for commercial or industrial use as of January 1, 2012.
