THE FISHERIES AMENDMENT ACT (OFFENCES AND PENALTIES)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Fisheries Act is amended by this Act.

Subsection 25(1) is amended by striking out "$10,000." and substituting "$100,000.".

The following is added after section 27:

Interference prohibited

27.1(1)

No person shall remove, damage or in any way interfere with any net or other fishing gear or equipment set out by any other person for the purpose of catching fish.

Exception for officers

27.1(2)

Subsection (1) does not apply to an officer in the performance of his or her duties under this Act or the Fisheries Act (Canada).

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill makes two changes to The Fisheries Act. It increases the maximum penalty under the Act from $10,000. to $100,000. The Bill also makes it an offence to remove fishing equipment set by another person.
