THE VITAL STATISTICS AMENDMENT ACT

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
C.C.S.M. c. V60 amended
1 The Vital Statistics Act is amended by this Act.
2(1) Subsection 3(11) of the English version is amended by striking out "he or she" and substituting "the person".
2(2) Subsection 3(13) is replaced with the following:
Procedure where responsible persons not found
3(13) The event registrar shall, if unable to find any of the persons required under subsection (2) to provide a statement respecting the birth of a child, complete the statement with the particulars known to the event registrar, and the statement constitutes the registration of the birth.
3 Subsections 22(1) and (3) of the English version are amended by striking out "him or her" and substituting "the director".
4(1) Subsection 25(1) of the English version is amended
(a) in the definition "health care professional", by replacing clause (a) with the following:
(a) is licensed, certified or registered to practise their health care profession in the jurisdiction within which they practise; and
(b) in the definition "resident of Manitoba", by striking out "his or her" and substituting "their".
4(2) Subsection 25(5) is amended in item 2 by replacing the part before clause (a) with the following:
2. If the applicant is a minor, one of the following:
4(3) Subsection 25(8) is amended by replacing everything before item 1 with the following:
Supporting letter requirements
25(8) A supporting letter for an applicant who is a minor must meet the following requirements:
4(4) Subsection 25(8) is further amended in item 2
(a) in clause (d) of the English version, by striking out "his or her" and substituting "their"; and
(b) by replacing clause (f) with the following:
(f) include a statement that the health care professional is of the opinion that the applicant has the capacity to make health care decisions;
5 Clause 30(6)(b) of the English version is amended by striking out "his or her" and substituting "the event registrar's".
6 In the following provisions of the English version, "his or her" is struck out and "their" is substituted:
(a) clause 32(2)(f);
(b) clause 32(7)(d);
(c) clause 32(8.1)(d);
(d) clause 32(13)(e);
(e) section 42.1.
7 Subclause 45.2(1)(b)(ii) of the English version is amended by striking out "him or her" and substituting "the person".
8 Clause 48(n) of the English version is amended by striking out "his or her" and substituting "their".
Coming into force
9 This Act comes into force on the day it receives royal assent.
Explanatory Note The Vital Statistics Act is amended. A person 18 years of age or older is no longer required to include a supporting letter from a health care professional when applying for a change of sex designation. Additional amendments are made in the English version to incorporate gender-neutral language. |
