HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. H60 amended

1           The Highway Traffic Act is amended by this Act.

2(1)        Subsection 145(4) is replaced with the following:

Helmet required

145(4)      Subject to the regulations made under subsection (4.1), no person who is under 16 years of age shall ride on or operate a bicycle or a power-assisted bicycle on a highway or bicycle facility unless he or she is wearing a properly fitted and fastened protective helmet.

2(2)        The following is added after subsection 145(4):

Regulations re exemption

145(4.1)    The Lieutenant Governor in Council may make regulations exempting a person or class of persons from the requirements of subsection (4) and may prescribe conditions for those exemptions.

Coming into force

3           This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill requires a person under 16 years of age riding a bicycle or a power-assisted bicycle on a highway or bicycle path to wear a proper protective helmet. Regulations may be made to exempt persons or classes of persons from the requirement.
