THE MANITOBA PUBLIC INSURANCE CORPORATION AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Manitoba Public Insurance Corporation Act is amended by this Act.

Section 197 is amended

(a) by renumbering it as subsection 197(1);

(b) by striking out "Where, as a result" and substituting "Subject to subsection (2), where, as a result"; and

(c) by adding the following as subsection 197(2):

Exception

197(2)

If part of a disability benefit referred to in subsection (1) is payable to the victim as the result of a division of pensionable earnings under the Canada Pension Plan, the corporation shall not deduct that amount from the victim's income replacement indemnity.

This Act comes into force on the day it receives royal assent.
