THE STATUTE LAW AMENDMENT ACT, 2000


 

(Assented to August 18, 2000)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

PART 1

GENERAL

THE CERTIFIED GENERAL ACCOUNTANTS ACT

C.C.S.M. c. C46 amended

1(1)      The Certified General Accountants Act is amended by this section.

1(2)      The title of the French version of the Act is amended by striking out "LICENCIÉS" and substituting "ACCRÉDITÉS".

1(3)      The definition "Association" in section 1 of the French version is amended by striking out "licenciés" and substituting "accrédités".

1(4)      The definition "cabinet de comptables" in section 1 of the French version is repealed and the following is substituted:

« cabinet de comptables » ou « cabinet de comptables à responsabilité limitée » Corporation titulaire d'un permis valide. ("professional corporation")

1(5)      Clause (a) of the definition "certificat" in section 1 of the French version is amended by striking out "licencié" and substituting "accrédité".

1(6)      The definition "comptable général licencié" in section 1 of the French version is amended by striking out "licencié" and substituting "accrédité".

1(7)      Subsection 2(1) of the French version is amended by striking out "licenciés" and substituting "accrédités".

1(8)      In the following provisions of the French version "licencié" is struck out and "accrédité" is substituted:

(a) clause 6(1)(e);

(b) subsections 9(1) and (3), wherever it occurs.

1(9)      Subsection 11(2) of the French version is amended

(a) in clause (c), by striking out "sa corporation professionnelle" and substituting "son cabinet de comptables à responsabilité limitée"; and

(b) in clause (e), by striking out "licencié" and substituting "accrédité".

1(10)     Clause 11.3(1)(b) and subsection 11.5(1) of the French version are amended

(a) by striking out "licencié" and substituting "accrédité"; and

(b) by striking out "licenciés" and substituting "accrédités".

1(11)     Subclause 11.9(2)(d)(ii) of the English version is amended by striking out "more for" and substituting "for more".

THE CHARTERED ACCOUNTANTS ACT

C.C.S.M. c. C70 amended

2(1)      The Chartered Accountants Act is amended by this section.

2(2)      The definition "cabinet de comptables" in section 1.1 of the French version is repealed and the following is substituted:

« cabinet de comptables » ou « cabinet de comptables à responsabilité limitée » Corporation titulaire d'un permis valide. ("professional corporation")

2(3)      Subsection 20(1) of the French version is amended

(a) in clause (e), by striking out "de la corporation" and substituting "du cabinet"; and

(b) in clause (f), by striking out "la corporation" and substituting "du cabinet".

2(4)      Subclause 34(2)(c)(ii) of the French version is amended by striking out "la cabinet" and substituting "le cabinet".

THE COMMODITY FUTURES ACT

C.C.S.M. c. C152 amended

3         Subsection 61(1) of the English version of The Commodity Futures Act is amended by adding "the" after "similar to this Act,".

THE CONSTRUCTION INDUSTRY WAGES ACT

C.C.S.M. c. C190 amended

4(1)      The Construction Industry Wages Act is amended by this section.

4(2)      The definition "heavy construction employees" in section 1 of the English version is amended by striking out "or" at the end of clause (b).

4(3)      The definition "minister" in section 1 is repealed and the following is substituted:

"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act; (« ministre »)

4(4)      Subsection 6(2) is amended in the part before clause (a) by striking out "employees employed in the heavy construction sector of the construction industry" and substituting "heavy construction employees".

4(5)       Subsection 12(4) is amended

(a) in the section heading, by striking out "Act" and substituting "Code"; and

(b) in the subsection, by striking out "The Employment Standards Act" and substituting "The Employment Standards Code".

4(6)      Subsection 14(4) is amended

(a) in the section heading, by striking out "Payment of Wages Act" and substituting "Employment Standards Code"; and

(b) in the subsection, by striking out "The Payment of Wages Act" and substituting "The Employment Standards Code".

4(7)      Subsection 16.1(1) is amended by striking out "under section 1 of The Payment of Wages Act" and substituting "in clause (b) of the definition of "board" in subsection 1(1) of The Employment Standards Code".

4(8)      Subsection 16.1(2) is amended by striking out "subsection 8(12) of The Payment of Wages Act" and substituting "section 110 of The Employment Standards Code".

4(9)      Subsection 18(2) is amended

(a)  in the section heading by striking out "Payment of Wages Act" and substituting "Employment Standards Code"; and

(b) in the subsection

(i) by striking out "The Payment of Wages Act" and substituting "The Employment Standards Code", and

(ii) by striking out "that Act" in the English version and substituting "that Code".

4(10)     Section 19.1 is amended by striking out "Act" and substituting "Code".

THE COURT OF QUEEN'S BENCH SMALL CLAIMS PRACTICES ACT

C.C.S.M. c. C285 amended

5(1)      The Court of Queen's Bench Small Claims Practices Act is amended by this section.

5(2)      Clause 21(1)(c) is amended by striking out "and accompanied by an official "acknowledgment of receipt" form".

5(3)      Subsection 21(3) is amended by striking out "thereof as shown on the "acknowledgement of receipt" form signed by the person acknowledging receipt thereof" and substituting "confirmed by Canada Post Corporation".

THE DENTAL ASSOCIATION ACT

C.C.S.M. c. D30 amended

6(1)      The Dental Association Act is amended by this section.

6(2)      The definition "cabinet de dentistes" in section 1 of the French version is repealed and the following is substituted:

« cabinet de dentistes » ou « cabinet de dentistes à responsabilité limitée » Corporation titulaire d'un permis valide. ("dental corporation")

6(3)      In the following provisions of the French version,"à responsabilité limitée" is added after "dentistes":

(a) clause 23.3(1)(b);

(b) subsection 23.5(1).

6(4)      Clause 23.8(2)(a) of the French version is amended by striking out "de dentistes".

THE MANITOBA EVIDENCE ACT

C.C.S.M. c. E150 amended

7         Subsection 64(4) of the English version of The Manitoba Evidence Act is amended by striking out "inacapable" and substituting "incapable".

THE DEPARTMENT OF HEALTH ACT

C.C.S.M. c. H20 amended

8         Section 9 of The Department of Health Act is repealed.

THE HIGHWAY TRAFFIC AMENDMENT, OFF-ROAD VEHICLES AMENDMENT AND CONSEQUENTIAL AMENDMENTS ACT

S.M. 1999, c. 12 amended

9         Section 26 of The Highway Traffic Amendment, Off-Road Vehicles Amendment and Consequential Amendments Act, S.M. 1999, c. 12, is repealed.

THE HIGHWAY TRAFFIC AMENDMENT AND SUMMARY CONVICTIONS AMENDMENT ACT

S.M. 1999, c. 43 amended

10        Subsection 1(3) of The Highway Traffic Amendment and Summary Convictions Amendment Act, S.M. 1999, c. 43, is repealed and the following is substituting:

1(3)      Subsection 279(1.4) is amended by adding ", section 273.2.1 (default in fine or restitution order)" after "(default in maintenance)".

THE DEPARTMENT OF LABOUR ACT

C.C.S.M. c. L20 amended

11        Section 9 of The Department of Labour Act is repealed.

THE LAW SOCIETY ACT

12(1)     The Law Society Act is amended by this section.

12(2)     The definition "cabinet d'avocats" in section 1 of the French version is repealed and the following is substituted:

« cabinet d'avocats » ou « cabinet d'avocats à responsabilité limitée » Corporation titulaire d'un permis valide délivré en vertu de l'article 61.3. ("law corporation")

12(3)     Section 36 of the English version is amended by adding "or" at the end of subclause (o)(xii).

12(4)     Subsection 61.2(2) of the French version is amended

(a) in the section heading, by adding "membres d'une société" after "Cabinets d'avocats";

(b) in the part before clause (a), by adding "à responsabilité limitée" after "cabinets d'avocats" wherever it occurs; and

(c) in clause (b), by striking out "le cabinet" and substituting "la société en nom collectif".

12(7)     Subsection 61.4(1) of the French version is amended by adding "à responsabilité limitée" after "d'avocats".

12(8)     Subsection 61.4(3) of the French version is amended

(a) in the section heading, by striking out "corporations professionnelles" and substituting "cabinets d'avocats à responsabilité limitée"; and

(b) in the subsection,

THE LIFE LEASES AND CONSEQUENTIAL AMENDMENTS ACT

S.M. 1998, c. 42 amended

13        Section 54 of the French version of The Life Leases and Consequential Amendments Act, S.M. 1998, c. 42, is amended by striking out "Loi sur le paiement des salaires" and substituting "Code des normes d'emploi".

THE MEDICAL ACT

C.C.S.M. c. M90 amended

14(1)     The Medical Act is amended by this section.

14(2)     The definition "cabinet de médecins" in section 1 of the French version is repealed and the following is substituted:

« cabinet de médecins » ou « cabinet de médecins à responsabilité limitée » Corporation titulaire d'une licence valide délivrée en application de l'article 22. ("medical corporation")

14(3)     Clause 22(1)(b) of the French version is amended by adding "à responsabilité limitée" after "médecins".

14(4)     Subsection 23(1) of the French version is amended by adding "à responsabilité limitée" after "médecins".

14(5)     Subsection 31(5) is amended by striking out "lay councillors" and substituting "councillors who are public representatives".

14(6)     Subsection 31(7) is amended

(a) in the section heading, by striking out "lay councillors" and substituting "public representatives"; and

(b) in the subsection, by striking out "lay councillor" wherever it occurs and substituting "public representative".

THE MEDICAL AMENDMENT ACT

S.M. 1999, c. 39 amended

15        Subsection 11(2) of the English version of The Medical Amendment Act, S.M. 1999, c. 39, is amended by adding "to" after "continue".

THE MINES AND MINERALS ACT

C.C.S.M. c. M162 amended

16        Subsection 213(1) of The Mines and Minerals Act is amended by striking out "judicial district" and substituting "judicial centre".

THE MUNICIPAL ACT

C.C.S.M. c. M225 amended

17        Subsection 184(5) of the French version of The Municipal Act is amended by striking out "licenciés" and substituting "accrédités".

AN ACT TO GOVERN THE SUPPLY OF NATURAL GAS IN MANITOBA AND TO AMEND THE PUBLIC UTILITIES BOARD ACT

S.M. 1987-88, c. 65 amended

18        Sections 1 and 31 of An Act to Govern the Supply of Natural Gas in Manitoba and to Amend The Public Utilities Board Act, S.M. 1987-88, c. 65, are repealed.

THE MANITOBA PUBLIC INSURANCE CORPORATION ACT

C.C.S.M. c. P215 amended

19(1)     The Manitoba Public Insurance Corporation Act is amended by this section.

19(2)     Subsection 1(1) is amended

(a) by repealing the definition "general manager"; and

(b) by adding the following definition in alphabetical order:

"chief executive officer" means the president and chief executive officer of the corporation appointed under this Act; (« directeur général »)

19(3)      Section 4 of the English version is amended

(a) by striking out "general manager" and substituting "chief executive officer" in the section heading and in the section; and

(b) by adding "or her" after "his".

19(4)     Section 5 of the English version is amended by striking out "general manager" and substituting "chief executive officer" in the section heading and wherever it occurs in the section.

19(5)     Subsection 20(4) of the English version is amended

(a) by striking out "general manager" and substituting "chief executive officer" wherever it occurs in the section; and

(b) by adding "or her" after "his".

19(6)     Subsection 20(5) of the English version is amended

(a) by striking out ", general manager, or other officer" and substituting "or the chief executive officer or other officer"; and

19(7)     Section 193 of the English version is amended by striking out "general manager" and substituting "chief executive officer".

S.M. 1991-92, c. 44 repealed

20        The Public Sector Compensation Management Act, S.M. 1991-92, c. 44, is repealed.

THE PUBLIC SECTOR REDUCED WORK WEEK AND COMPENSATION MANAGEMENT ACT

S.M. 1993, c. 21 repealed

21        The Public Sector Reduced Work Week and Compensation Management Act, S.M. 1993, c. 21, is repealed.

THE REGIONAL WASTE MANAGEMENT AUTHORITIES ACT

C.C.S.M. c. R38 amended

22        Subsection 17(2) of the French version of The Regional Waste Management Authorities Act is amended by striking out "licenciés" and substituting "accrédités".

28         The Cattle Producers Association Act is amended by striking out "Minister of Agriculture" and substituting "Minister of Agriculture and Food" in the following provisions:

31        Subsection 267(2) of The Corporations Act is amended in the part after clause (d) by striking out "Minister of Rural Development" and substituting "Minister of Intergovernmental Affairs".

32        The definition "minister" in section 1 of The Crop Insurance Act is amended by striking out "Minister of Agriculture" and substituting "minister appointed by the Lieutenant Governor in Council to administer this Act".

THE CROWN LANDS ACT

33(1)     The Crown Lands Act is amended by this section.

33(2)     Section 1 is amended by adding the following definition in alphabetical order:

"department" means the department of government over which the minister presides and through which this Act is administered; (« ministère »)

33(3)     Section 2 is amended

(a)  by striking out "The Department of Natural Resources" and substituting "the department "; and

(b)  in the English version,

(i) by adding "the minister" before "manages", and

(ii) by striking out "is continued" and substituting ", is continued".

34        The definition "department" in section 1 of The Dangerous Goods Handling and Transportation Act is repealed and the following is substituted:

36        The definition "local authority" in section 1 of The Emergency Measures Act is amended

(a) in clause (e), by striking out "Minister of Northern Affairs" and substituting "Minister of Aboriginal and Northern Affairs; and

38        The definition "department" in subsection 1(2) of The Environment Act is repealed and the following is substituted:

COMING INTO FORCE

Coming into force

88(1)     This Act, except sections 13, 15 and 49, comes into force the day it receives royal assent.

88(2)     Section 13 is retroactive and deemed to have come into force on December 1, 1999.
