THE STATUTE LAW AMENDMENT ACT, 1999

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
THE ANIMAL HUSBANDRY ACT
1 The Animal Husbandry Act, R.S.M. 1987, c. A90, is repealed.
THE BRANDON UNIVERSITY ACT
2 Subsection 6(4) of the French version of The Brandon University Act is amended by striking out "et" and substituting "ni".
THE CENTENNIAL CENTRE CORPORATION ACT
3 Subsection 7(1) of the English version of The Centennial Centre Corporation Act is amended by striking out "on of April 1" and substituting "on April 1".
THE CERTIFIED APPLIED SCIENCE TECHNOLOGISTS ACT
4 Section 48 of the French version of The Certified Applied Science Technologists Act is amended by striking out "à la date fixée par proclamation" and substituting "le jour de sa sanction".
THE CONDOMINIUM ACT
5 Clause 34(b) of the English version of The Condominium Act is amended by striking out "clause 8(2)(i)" and substituting "clause 8(1.1)(i)".
THE COOPERATIVES AND CONSEQUENTIAL AMENDMENTS ACT
6(1) The Cooperatives and Consequential Amendments Act, S.M. 1998, c. 52, is amended by this section.
6(2) Subsection 19(1) of the English version is amended by striking out "at the time at the time" and substituting "at the time".
6(3) Subsections 361(3) and 362(2) of the English version are amended by striking out "Consolidated Revenue Fund" and substituting "Consolidated Fund".
THE CORPORATIONS ACT
C.C.S.M. c. C225 amended
7 Subsections 220(3) and 221(2) of the English version of The Corporations Act are amended by striking out "Consolidated Revenue Fund" and substituting "Consolidated Fund".
THE CORPORATIONS AMENDMENT ACT
8 Clause 5(1)(a) of The Corporations Amendment Act, S.M.1997, c. 26, is amended by adding "(Canada)" after "Canada Deposit Insurance Corporation Act".
THE COURT OF QUEEN'S BENCH ACT
9 Section 41 of The Court of Queen's Bench Act is amended
(a) by adding the following before clause (e):
(d.1) The Adoption Act;
(b) in clause (r) by striking out "The Divorce Act, 1985" and substituting "the Divorce Act".
THE COURT OF QUEEN'S BENCH SURROGATE PRACTICE ACT
10 Subclause 50(b)(vi) of the English version of The Court of Queen's Bench Surrogate Practice Act is amended by striking out "Isle of Mann" and substituting "Isle of Man".
THE CROWN CORPORATIONS PUBLIC REVIEW AND ACCOUNTABILITY ACT
11(1) The Crown Corporations Public Review and Accountability Act is amended by this section.
11(2) Subsection 20(4) is repealed and the following is substituted:
Statements to members of the Assembly
20(4) Quarterly financial statements shall not be made public under subsection (2) until
(a) they are laid before the Legislative Assembly; or
(b) if the Legislative Assembly is not sitting, they are sent to each member of the Legislative Assembly.
11(3) The Schedule is repealed and the following is substituted:

THE ELECTIONS ACT
12 Subsection 77(2) of The Elections Act is amended by striking out "subsection 78(2)" and substituting "section 78".

13 The definition "educational body" in section 1 of The Freedom of Information and Protection of Privacy Act is amended by repealing clause (c) and substituting the following:

THE FREEDOM OF INFORMATION AND PROTECTION OF PRIVACY AND CONSEQUENTIAL AMENDMENTS ACT
14 Section 97 of The Freedom of Information and Protection of Privacy and Consequential Amendments Act, S.M. 1997, c. 50, is amended
(a) by striking out "section 116" and substituting "section 115"; and
(b) by renumbering section 117 as section 116.
THE LEGISLATIVE ASSEMBLY ACT
15 Subsection 52.1(1) of The Legislative Assembly Act is amended by adding "The Freedom of Information and Protection of Privacy Act or" after "Notwithstanding".
THE LIVESTOCK INDUSTRY DIVERSIFICATION ACT
16 Subsection 11(2) of the English version of The Livestock Industry Diversification Act is amended by striking out "persons" and substituting "person".
THE MENNONITE COLLEGE FEDERATION ACT
17 Clause 10(1)(g) of the French version of The Mennonite College Federation Act is amended by striking out "accordent" and substituting "accordant".
THE NORTHERN AFFAIRS ACT
18 Subsection 21.1(4) of the French version of The Northern Affairs Act is amended by striking out "minsitre" and substituting "ministre".
THE PUBLIC HEALTH ACT
19 Clause 13(d) of The Public Health Act is amended by striking out "unoccupied" and substituting "occupied".
THE MANITOBA PUBLIC INSURANCE CORPORATION ACT
C.C.S.M. c. P215 amended
20 Section 123 of the French version of The Manitoba Public Insurance Corporation Act is repealed and the following is substituted:
Admissibilité des enfants et de la mère ou du père
123 Tous les enfants ainsi que la mère et le père d'une victime ont droit à une indemnité forfaitaire de 5 000 $ pour autant que cette dernière n'ait, à son décès, aucune personne à charge.
THE PROVINCIAL RAILWAYS ACT
21 Subsection 46(1) of the English version of The Provincial Railways Act is amended by striking out "And Geoscientific" and substituting "and Geoscientific".
THE REAL ESTATE BROKERS ACT
22(1) The Real Estate Brokers Act is amended by this section.
22(2) The definition "sommes fiducie" in section 1 of the French version is amended by adding "en" after "sommes".
22(3) Subsections 26(1.1) and (1.4) are amended by striking out " l'argent déposé en fiducie" and substituting " les sommes en fiducie".
THE REAL PROPERTY ACT
23(1) The Real Property Act is amended by this section.
23(2) Subsection 110(1) is repealed and the following is substituted:
110(1) Where a registered mortgage has been amended by agreement to
(a) extend the period for repayment of the unpaid balance owing under the mortgage upon revised terms;
(b) vary any other term of the mortgage, other than the description of the mortgaged land;
(c) add the name of a person as covenantor under the mortgage; or
(d) correct an error made prior to the execution of the mortgage or an amending agreement previously registered under this section;
a memorandum of agreement in the form prescribed by regulation may be registered.
23(3) Subsection 110(2) is amended by adding ", other than an agreement that only adds the name of a person as a covenantor under the mortgage, " after "under subsection (1)".
23(4) Subsection 110(3) is amended by striking out "in respect of the balance of principal and interest that is unpaid at the date of the agreement and that is repayable according to the revised terms".
THE UNIVERSITY OF WINNIPEG ACT
24(1) The University of Winnipeg Act is amended by this section.
24(2) Clause 13(a) of the French version is amended by striking out "la rue Portage" and substituting "l'avenue Portage".
24(3) Clause 17(1)(j) of the French version is amended by striking out "son sein" and substituting "leur sein".
COMING INTO FORCE
Coming into force
25(1) This Act, except sections 1, 4, 6, 8, 13, 14, 15 and 20, comes into force the day it receives royal assent.
25(2) Section 1 is retroactive and is deemed to have come into force on August 1, 1998.
25(3) Section 4 is retroactive and is deemed to have come into force on June 29, 1998.
25(4) Section 6 comes into force on the proclamation of The Cooperatives and Consequential Amendments Act, S.M. 1998, c. 52.
25(5) Section 8 is retroactive and is deemed to have come into force on February 1, 1999.
25(6) Section 13 is retroactive and is deemed to have come into force on July 1, 1998.
Coming into force: sections 14 and 15
25(7) Sections 14 and 15 are retroactive and are deemed to have come into force on May 4, 1998.
Coming into force: section 20
25(8) Section 20 is retroactive and is deemed to have come into force on March 1, 1994.
