THE STATUTE LAW AMENDMENT ACT, 1997
(Assented to June 28, 1997)
HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
THE INTERCOUNTRY ADOPTION (HAGUE CONVENTION) ACT
1 The last paragraph of the Schedule to The Intercountry Adoption (Hague Convention) Act is amended by striking out "Done at The Hague, on the day of 19 ," and substituting "Done at The Hague, on the 29th day of May, 1993".
THE ANIMAL DISEASES ACT
2(1) The Animal Diseases Act is amended by this section.
2(2) Section 1 is amended by repealing the definition "deprivation".
2(3) Section 3 is amended in the part preceding clause (a) by striking out "or is suffering from deprivation or inhumane treatment".
2(4) Subsection 5(1) is amended by striking out "or suffering from deprivation".
2(5) Section 6(2) is amended
(a) in clause (a), by striking out "or suffering from deprivation"; and
(b) in clause (b), by striking out "or deprivation".
2(6) Section 9 is amended by striking out "or is suffering from deprivation".
2(7) Subsection 12(3) is amended by striking out "the humane practices and".
2(8) Section 13 is repealed.
2(9) Section 19 is amended
(a) in clause (b), by striking out "or suffering from deprivation";
(b) in clause (q), by striking out "humane,"; and
(c) by repealing clause (t).
THE CROP INSURANCE ACT
3 Clause 20(3)(e) of the French version of The Crop Insurance Act is amended by striking out "e)" and substituting "d)".
THE DANGEROUS GOODS HANDLING AND TRANSPORTATION ACT
4 Subsection 31.1(2) of the French version of The Dangerous Goods Handling and Transportation Act is renumbered as subsection 32.1(2).
THE FARM LANDS OWNERSHIP ACT
5 Subsection 1(1) of the French version of The Farm Lands Ownership Act is amended in the definition « immigrant qualifié " by striking out "qualifié" and substituting "admissible".
THE HEALTH AND POST SECONDARY EDUCATION TAX LEVY ACT
6(1) The Health and Post Secondary Education Tax Levy Act is amended by this section.
6(2) Section 3.2 of the French version is amended by striking out "la taxe imposée" and substituting "l'impôt établi".
6(3) Clause 38(1)(e) of the French version is amended by striking out "de taxe" and substituting "d'impôt".
THE HIGHWAYS AND TRANSPORTATION DEPARTMENT ACT
7(1) The Highways and Transportation Department Act is amended by this section.
7(2) Clauses 7(1)(d), (e) and (f) are repealed.
7(3) Subsection 7(3) is repealed.
7(4) Subsection 16(1) is amended
(a) by repealing the section heading and substituting "Declaration as provincial trunk highway ceases";
(b) by striking out "is abandoned as a provincial trunk highway and is not declared to be a provincial road" and substituting "ceases to be declared a provincial trunk highway and is not declared to be a provincial road or industrial road or closed under section 17"; and
(c) by striking out "shall be deemed to be relinquished by the government and to be" and substituting "is relinquished by the government and is".
7(5) Subsection 16(2) is amended
(a) by repealing the section heading and substituting "Declaration as provincial road ceases";
(b) by striking out "is abandoned as a provincial road and is not declared to be a provincial trunk highway" and substituting "ceases to be declared a provincial road and is not declared to be a provincial trunk highway or industrial road or closed under section 17"; and
(c) by striking out "shall be deemed to be relinquished by the government and to be" and substituting "is relinquished by the government and is".
7(6) Subsection 16(3) is amended
(a) by repealing the section heading and substituting "Declaration as industrial road ceases";
(b) by striking out "is abandoned as an industrial road and is not declared to be a provincial trunk highway or a provincial road" and substituting "ceases to be declared an industrial road and is not declared to be a provincial trunk highway or a provincial road or closed under section 17"; and
(c) by striking out "shall be deemed to be relinquished by the government and to be" and substituting "is relinquished by the government and is".
THE HOSPITAL CAPITAL FINANCING AUTHORITY ACT
8 The Hospital Capital Financing Authority Act is amended
(a) in the French version of section 14, by striking out "lieutenant-gouveneur" and substituting "lieutenant-gouverneur"; and
(b) in the French version of section 15, by striking out "loi sur les corporations" and substituting "Loi sur les corporations".
THE INTERPRETATION ACT
9 Clause (c) in the definition "peace officer" in subsection 22(1) of The Interpretation Act is amended
(a) by striking out "bailiff, bailiff's officer,"; and
(b) by striking out "or for the service or execution of civil process".
THE LAW FEES ACT
10 Section 9 of The Law Fees Act is repealed.
THE LEGAL AID SERVICES SOCIETY OF MANITOBA ACT
11(1) The Legal Aid Services Society of Manitoba Act is amended by this section.
11(2) Subsection 5(5) is repealed.
11(3) Subsection 5(8) is amended by striking out ", not including the director nominated by the Attorney-General of Canada,".
THE MEDICAL ACT
12 Subsection 59.7(3) of the French version of The Medical Act is amended by striking out "le registraire suspend" and substituting "le registraire peut suspendre".
THE MINING TAX ACT
13 Section 8 of the French version of The Mining Tax Act is amended by striking out "avait un de lien de dépendance" and substituting "avait un lien de dépendance".
THE MUNICIPAL ASSESSMENT ACT
14 Subsection 1(1) of The Municipal Assessment Act is amended in the English version of the definition "total school assessment" by striking out "and" at the end of the definition.
THE PARI-MUTUEL LEVY ACT
15 Clause 36(d) of the French version of The Pari-Mutuel Levy Act is amended by adding « déterminer » after "permettre à la Commission de ».
THE PROVINCIAL RAILWAYS ACT
16(1) The Provincial Railways Act is amended by this section.
16(2) Subsection 1(1) is amended
(a) by repealing the definition "National Transportation Agency"; and
(b) by adding the following definition in alphabetical order:
"Canadian Transportation Agency" means the Canadian Transportation Agency continued under subsection 7(1) of the Canada Transportation Act; « Office des transports du Canada »
16(3) Clause 4(a) and subclause 4(b)(i) are amended by striking out "National Transportation Agency" wherever it occurs and substituting "Canadian Transportation Agency".
16(4) Section 5 is amended by striking out "National Transportation Act, 1987" and substituting "Canada Transportation Act" in the section heading and in the section.
16(5) Subsection 13(1) is amended
(a) in clause (b) of the English version, by striking out "National Transportation Agency" and substituting "Canadian Transportation Agency"; and
(b) in clause (c), by striking out "National Transportation Act, 1987" and substituting "Canada Transportation Act".
THE REAL ESTATE BROKERS ACT
17 Clause 26(1.7)(a) of The Real Estate Brokers Act is repealed.
THE RURAL DEVELOPMENT BONDS ACT
18 Clause 28(2)(b) of The Rural Development Bonds Act is amended by striking out "the prescribed".
THE SPECIAL OPERATING AGENCIES FINANCING AUTHORITY ACT
19(1) The Special Operating Agencies Financing Authority Act is amended by this section.
19(2) Subsection 11(1) is amended
(a) in the part preceding clause (a), by striking out "and the minister responsible for the administration of any department, division, branch or program of the government"; and
(b) in clause (a), by striking out "the department, division, branch or program" and substituting "any department, division, branch or program of the government".
19(3) Section 12 is amended by striking out everything after "Finance".
19(4) Section 15 is amended by striking out "and the minister responsible for the administration of an agency".
THE TEACHERS' PENSIONS ACT
20 Subsection 11(3.1) of The Teachers' Pensions Act is amended
(a) by striking out "allowance" and substituting "pension"; and
(b) in the English version, by adding "of" after "application".
THE MANITOBA TRADE AND INVESTMENT CORPORATION ACT
21 Subsection 7(6) of the English version of The Manitoba Trade and Investment Corporation Act is amended by striking out "by him".
COMING INTO FORCE
22(1) This Act, except sections 1, 2, 16 and 18, comes into force on the day it receives royal assent.
22(2) Section 1 is retroactive and is deemed to have come into force on November 3, 1995.
22(3) Section 2 comes into force on the day the The Animal Care Act, S.M. 1996, c. 69, comes into force.
22(4) Section 16 is retroactive and is deemed to have come into force on July 1, 1996.
22(5) Section 18 is retroactive and is deemed to have come into force on November 3, 1995.
