THE PUBLIC SCHOOLS AMENDMENT ACT


 

(Assented to June 28, 1997)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Public Schools Act is amended by this Act.

Subsection 25(6) is repealed and the following is substituted:

Minister may approve increase or decrease in term of office

The minister may approve a written request from a school board, other than the board of a school division mentioned in subsection (2), to

(a) decrease the term of office of trustees

(i) from three years to two years or one year, or

(ii) from two years to one year; or

(b) increase the term of office of trustees

(i) from one year to two years or three years, or

(ii) from two years to three years.

Subsection 52(2) is amended by striking out "and" at the end of clause (d), by adding "and" at the end of clause (e), and by adding the following after clause (e):

(f) the South Winnipeg Technical Centre;

Subsection 174(2) is repealed.

Sections 186.1 and 186.2 are repealed.

Subsection 258(2) is repealed and the following is substituted:

Compulsory school age

258(2)

A child who is seven years of age or older on December 31 in a year is deemed to be of compulsory school age at the beginning of the fall term of that year.

Section 259 is repealed and the following is substituted:

Right to attend school

259(1)

In accordance with this Act, a person who

is six years of age or older on December 31 in a year has the right to attend school from the beginning of the fall term of that year until

(a) the last school day of June in the year in which the person becomes 21 years of age; or

(b) the day the person receives a graduation diploma as defined in the regulations;

whichever comes first.

Regulations

259(2)

The minister may make regulations defining "graduation diploma" for the purpose of clause (1)(b).

Repeal

Sections 17 and 18 of The Public Schools Amendment Act, S.M. 1996, c. 51, are repealed.

Coming into force

This Act comes into force on the day it receives royal assent.
