THE SURFACE RIGHTS AMENDMENT ACT

(Assented to October 22, 1996)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. S235 amended

1          The Surface Rights Act is amended by this Act.

2(1)      Subsection 18(1) is amended by striking out "A lease" and substituting "Subject to subsection (2), a lease".

2(2)      Subsection 18(2) is repealed and the following is substituted:

Waiver of waiting period

18(2      ) An owner or occupant may waive the requirements of subsection (1) only by executing a waiver that is in a form approved by the board.

Coming into force

3         This Act comes into force on the day it receives royal assent.
