The Statute Law Amendment Act, 1990-91
(Assented to December 14, 1990)
HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
THE CERTIFIED GENERAL ACCOUNTANTS ACT
1(1) The Certified General Accountants Act is amended by this section.
1(2) Subsection 6(1) is amended by striking out "4, 17 and 18" in clause (dd) and substituting "4 and 18".
1(3) Subsection 12(7) is amended by striking out "(2)" and substituting "(3)".
THE CHILD AND FAMILY SERVICES ACT
2(1) The Child and Family Services Act is amended by this section.
2(2) Subsection 19.3(4) is amended by striking out "18(1)" and substituting "18(1.1)".
2(3) Subsection 69(5) is amended by striking out "subsection (2) and (3)" and substituting "subsections (2) and (3)".
THE COMMUNITIES ECONOMIC DEVELOPMENT FUND ACT
3(1) The Communities Economic Development Fund Act is amended by this section.
3(2) Section 26 is amended by adding the following after subsection (5):
Economic enterprises outside remote and isolated communities
26(6) No loan, guarantee or other financial assistance granted or provided by the fund to an economic enterprise before the coming into force of this subsection, and no security taken or acquired by the fund in respect of the financial assistance, is invalid or unenforceable by reason only that the economic enterprise is not located in a remote and isolated community.
THE CROWN LANDS ACT
4 Section 19 of The Crown Lands Act is amended by striking out "50.1" and substituting "51".
THE DANGEROUS GOODS HANDLING AND TRANSPORTATION ACT
5 The English version of the definition of "environmental accident" in section 1 is amended by striking out "the Clean Environment Act" and substituting "The Environment Act".
THE ELECTIONS ACT
6 Clause 31(b) of The Elections Act is repealed.
THE EMERGENCY MEASURES ACT
7 The English version of subsection 14(2) of The Emergency Measures Act is amended by striking out "act" and substituting "Act".
THE GASOLINE TAX ACT
8 Subsection 25(6) of The Gasoline Tax Act is amended by striking out "clause 16(4)(e)" and substituting "subsection 16(4)".
THE HEALTH AND POST SECONDARY EDUCATION TAX LEVY ACT
9 Subsection 12(1) of The Health and Post Secondary Education Tax Levy Act is amended by striking out "lien charge" and substituting "lien and charge".
THE HEALTH SERVICES INSURANCE ACT
10(1) The Health Services Insurance Act is amended by this section.
10(2) Subsection 2(1) is amended by striking out "registered dentist" in the definition of "in-patient" and substituting "licensed dentist".
10(3) Section 28 is amended by striking out "Health Services Fund" and substituting "Health Services Insurance Fund".
10(4) Subsection 50(1) is amended by striking out "Hospital Insurance and Diagnostic Services Act (Canada)" and substituting "Canada Health Act (Canada)".
10(5) Section 71 is amended
(a) by striking out "registered oral surgeons" and substituting "certified oral and maxillofacial surgeons"; and
(b) by striking out "registered dental surgeons" and substituting "licensed dentists".
THE INTERPRETATION ACT
11 The French version of subsection 3(1) of The Interpretation Act is amended by striking out "du consentement" and substituting "avec le consentement".
THE LAW FEES ACT
12(1) The Law Fees Act is amended by this section.
12(2) Subsection 2(2) is repealed.
12(3) Subsection 7(2) is repealed.
THE LAW OF PROPERTY ACT
13 The French version of subsection 17.7(3) of The Law of Property Act, now numbered 17.3(3) and appearing immediately after the French version of subsection 17.7(2), is renumbered as subsection 17.7(3).
THE MUNICIPAL ACT
14(1) The Municipal Act is amended by this section.
14(2) Section 330 is amended by striking out "The Clean Environment Act" and substituting "The Environment Act".
14(3) Subsection 725(5) is amended by striking out "registered mail" and substituting "ordinary mail".
THE PUBLIC HEALTH ACT
15 Subsection 27.1(7) of The Public Health Act is amended by striking out "Act" and substituting "section".
THE REAL PROPERTY ACT
16(1) The Real Property Act is amended by this section.
Sections 75, 108 and 153 amended
16(2) The Act is amended
(a) by striking out "certified mail" in subsection 75(11); and
(b) by striking out "registered or certified mail" in section 108 and again in section 153;
and, in each case, substituting "ordinary mail".
16(3) The following is added after section 167:
167.1 Where under this or any other Act of the Legislature notice of a registration or filing in a land titles office is required to be given by the district registrar to any person by registered or certified mail, the notice may be given by ordinary mail.
THE REVENUE ACT
17 Clause 42(2)(d) of The Revenue Act is repealed.
THE SOCIAL ALLOWANCES ACT
18(1) The Social Allowances Act is amended by this section.
18(2) Subsection 10(1) is amended by striking out "section 443" and substituting "section 451".
18(3) Subsection 21(5) is amended by striking out "registered mail" and substituting "ordinary mail".
THE PRIVATE VOCATIONAL SCHOOLS ACT
19 The English version of subsection 7(1) of The Private Vocational Schools Act is amended by striking out "registration on a renewal of registration" and substituting "registration or a renewal of registration".
THE CITY OF FLIN FLON ACT
20(1) The City of Flin Flon Act is amended by this section.
20(2) Section 11 is amended by striking out "8" and substituting "9".
20(3) Section 12 is amended by striking out "10" and substituting "11".
COMING INTO FORCE
21 This Act comes into force on the day it receives royal assent.
