The Official Time Act

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definitions.

In this Act

"Central Standard Time" means the mean time of the 90th degree of longitude west from Greenwich which is six hours behind Greenwich time; ("heure normale du centre")

"official time" means the time which under section 2 is required to be used and observed throughout the province. ("temps réglementaire")

Description of official time.

Throughout the province the official time which shall be used and observed shall be

(a) except between two o'clock Central Standard Time in the morning of the last Sunday in April of each year and two o'clock Central Standard Time in the morning of the last Sunday in October next following, Central Standard Time; and

(b) between two o'clock Central Standard Time in the morning of the last Sunday in April of each year and two o'clock Central Standard Time in the morning of the last Sunday in October next following, one hour in advance of Central Standard Time.

Prohibition of municipal action respecting time.

3(1)

Notwithstanding any other Act of the Legislature, no municipality shall, by by-law, resolution, or order, retain, adopt, proclaim, enforce, use, or observe any time other than official time, whether for the use, observance, and purposes of the residents of the municipality generally, or for the use, observance, and purposes of the employees of the municipality.

Certain by-laws void.

A by-law enacted, a resolution or order made, or a proclamation issued, by the council of any municipality or any officer thereof providing for the use, observance, or adoption, or the enforcement of the use, observance, or adoption, within the municipality, by the residents of the municipality generally, or by the employees of the municipality, of any time other than official time is void.

Meaning of expressions of time in Acts and documents.

Where, in any Act of the Legislature or regulation or order made thereunder, or in any order of the court, or in any contract, deed, or other instrument or agreement made or executed, whether passed, made, or executed heretofore or hereafter,

(a) an expression of or relating to time occurs; or

(b) any hour or period of time is stated either orally or in writing; or

(c) any question as to a time or period of time arises;

the time to which reference is made or intended shall, unless it is otherwise specifically stated, be conclusively deemed to be official time.

Saving.

This Act applies only as far as the Legislature has jurisdiction to enact; and it is declared that the purpose and intent of the Legislature is to confine the provisions of this Act within the competence of the Legislature, and every provision thereof shall be construed so as to give effect to that purpose and intent; and in particular, and without restricting the generality of the foregoing, this Act does not apply to or affect any person who, or corporation which, with respect to the time to be used and observed by him or it, is not subject to the jurisdiction of the Legislature.
