The Dental Health Workers Act

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
In this Act
"dental health worker" means a dental nurse, dental hygienist, dental technician, or a dental assistant who is trained and qualified to perform such dental services as are prescribed by the regulations and is duly registered in accordance with this Act; (" travailleur en sciences dentaires")
"minister" means the member of the Executive Council charged by the Lieutenant Governor in Council with the administration of this Act. ("ministre")
The government may make such arrangements as it considers necessary to provide for the education and training of dental health workers, either alone or through a department of government or in conjunction with The University of Manitoba or other educational institution.
The minister shall cause to be kept and maintained a register in which shall be entered the names and addresses and date of registration of every duly qualified dental health worker who has applied for registration and has paid the fee, if any, prescribed by the regulations.
Upon completion of registration under subsection (1), the minister or a person acting under his authority shall issue a certificate of registration to the dental health worker.
A person who, on or after the coming into force of this Act, is in the opinion of the minister, duly qualified as a dental health worker shall, upon payment of the prescribed fee, if any, be registered under this section.
The minister may delegate his functions and duties under this section to a board appointed by the Lieutenant Governor in Council.
Nothing in The Dental Association Act prohibits or restricts a dental health worker who holds a valid and subsisting certificate of registration under this Act from rendering or performing dental services as prescribed in the regulations.
Nothing in this Act shall be deemed to interfere with or abrogate the powers and duties of the Manitoba Dental Association established under The Dental Association Act or the powers and duties of a dentist registered under that Act to train in private dental offices, personnel as are mentioned in subsections 2(2) and (3) of The Dental Association Act, for employment in accordance with those subsections.
For the purpose of carrying out the provisions of this Act according to their intent, the Lieutenant Governor in Council may make such regulations and orders as are ancillary thereto and are not inconsistent therewith; and every regulation or order made under, and in accordance with the authority granted by, this section has the force of law; and, without restricting the generality of the foregoing, the Lieutenant Governor in Council may make regulations and orders,
(a) fixing fees for the purpose of this Act;
(b) prescribing what services constitute dental services;
(c) prescribing those dental services that may be carried out by a dental health worker without the supervision of a duly qualified dentist as defined in The Dental Association Act;
(d) prescribing those dental services that shall not be carried out by a dental health worker except under the supervision and control of a duly qualified dentist or duly qualified medical practitioner;
(e) respecting the suspension, revocation and reinstatement of certificates of registration and prescribing the reasons for which a certificate of registration may be suspended or revoked;
(f) prescribing the period of time during which a certificate of registration is valid and providing for the renewal thereof;
(g) appointing persons as inspectors under this Act and prescribing their powers and duties for the purpose of determining the quality of dental services being rendered by dental health workers;
(h) appointing a board for the purpose of this Act and prescribing its powers and duties; and
(i) respecting such other matters as he deems necessary for carrying out the purposes and objects of this Act.
