An Act to amend The Anatomy Act

Subsec. 4(4) added.

Section 4 of The Anatomy Act, being chapter A80 of the Re-enacted Statutes of Manitoba, 1987, is amended by adding thereto, immediately after subsection (3) thereof, the following subsection:

Where under the authority of subsection 3(1) of The Human Tissue Act the inspector proposes to make a direction for the use of the whole body or tissue from the body of a deceased person for therapeutic purposes as defined in that Act, and the inspector is satisfied that the deceased person is not survived by any preferred claimant or other person entitled to claim the body under this Act, the inspector may make the direction and the direction may be acted upon without waiting for the expiration of the period of 48 hours referred to in subsection (1) and notwithstanding any other provision of this Act to the contrary.

Subsections 5(5), (6) and (7) of the Act are repealed.

Subsec. 7(3) am.

Subsection 7(3) of the Act is amended by striking out the words and figures "a waiver or consent has been given under subsection (4) or (5) of section 5" where they appear therein and substituting therefor the words and figures "a waiver has been given under subsection 5(4)".

Subsection 14(1) of the Act is repealed.

Sec. 25 rep. and sub.

Section 25 of the Act is repealed and the following section is substituted therefor:

Offence and penalty.

A person who contravenes or fails to observe a provision of this Act or of any regulation made thereunder is guilty of an offence and liable, on summary conviction, to a fine of not more than $5,000. or to imprisonment for a term of not more than six months or to both.

Sec. 26 added.

The Act is amended by adding thereto, immediately after section 25 thereof as enacted by section 5 hereof, the following section:

Human Tissue Act.

This Act is subject to The Human Tissue Act.
