WHEREAS the council of the Rural Municipality of Victoria Beach on September 19, 1989 gave first reading to By-law No. 1218, to authorize a capital expenditure project to install a seasonal water system and to issue debentures for the project in the amount of $48,000.;

AND WHEREAS The Municipal Board found in a decision dated December 11, 1989 that the board was unable to approve the by-law, owing in part to non-compliance with certain provisions of section 626 of The Municipal Act;

ATTENDU QUE le Conseil de la municipalité rurale de Victoria Beach a, le 19 septembre 1989, adopté en première lecture l'arrêté n° 1218 qui autorise une dépense en capital pour l'installation d'une canalisation d'eau saisonnière ainsi que l'émission, pour le projet, de débentures totalisant 48 000 $;

ATTENDU QUE le Conseil municipal s'est rendu compte, à la lumière d'une décision datée du 11 décembre 1989, qu'il lui était impossible d'adopter l'arrêté en raison notamment de sa non-conformité avec certaines dispositions de l'article 626 de la Loi sur les municipalités;

THEREFORE, HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

PAR CONSÉQUENT, SA MAJESTÉ, sur l'avis et du consentement de l'Assemblée législative du Manitoba, édicte :

By-law validated

1 By-law No. 1218 of the Rural Municipality of Victoria Beach is hereby validated in the form in which it was given first reading by the council of the municipality on September 19, 1989; and the by-law shall be deemed for all purposes to be in compliance with section 626 of The Municipal Act, and to be approved by The Municipal Board under that section.

1 L'arrêté n° 1218 de la municipalité rurale de Victoria Beach est par la présente loi validé dans la forme dans laquelle le Conseil municipal l'a adopté en première lecture le 19 septembre 1989. Cet arrêté est, à toutes fins pratiques, réputé être conforme à l'article 626 de la Loi sur les municipalités et avoir été approuvé par le Conseil municipal en application du présent article.

Council authorized to proceed

2 The council of the Rural Municipality of Victoria Beach may proceed under subsection 626(22) of The Municipal Act to give second and third reading to By-law No. 1218.

Coming into force

3 This Act comes into force on the day it receives royal assent.
