HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Agreement approved

1   An agreement between the Government of Canada, represented therein by The Honourable Douglas Charles Abbott, Minister of Finance, of the first part and the Government of the Province of Manitoba, represented therein by The Honourable Douglas Lloyd Campbell, Premier of Manitoba of the second part, dated the eleventh day of June, 1951, a copy of which is set forth in the Schedule, is approved, ratified, and confirmed.

SCHEDULE

MEMORANDUM OF AGREEMENT

Made this eleventh day of June, 1951.

BETWEEN;

THE GOVERNMENT OF CANADA, represented herein by the Honourable Douglas Charles Abbott, Minister of Finance,

Of the first part,

AND

THE GOVERNMENT OF THE PROVINCE OF MANITOBA, represented herein by the Honourable Douglas Lloyd Campbell, Premier of Manitoba,

Of the second part.

WHEREAS the Agreement entered into between the parties hereto on the 14th day of December, 1929, (hereinafter referred to as the Natural Resources Transfer Agreement) was duly approved by the Parliament of Canada and the Legislature of the Province and upon an address to His Majesty from the Senate and House of Commons of Canada, was confirmed and declared to have the force of law by an Act of the Parliament of the United Kingdom of Great Britain and Northern Ireland entitled "The British North America Act, 1930" being chapter twenty-six of the Imperial Statutes, 20-21 George V;

AND WHEREAS by paragraph twenty-four of the said Natural Resources Transfer Agreement it was agreed that the provisions of the said Agreement might be varied by an Agreement confirmed by concurrent Statutes of the Parliament of Canada and the Legislature of the Province;

AND WHEREAS paragraphs six and seven of the National Resources Transfer Agreement provide as follows:

"6. Upon the coming into force of this Agreement, Canada will transfer to the Province the money or securities constituting that portion of the School Lands Fund, created under sections twenty-two and twenty-three of The Act to amend and consolidate the several Acts respecting Public Lands of the Dominion, being chapter thirty-one of forty-two Victoria, and subsequent statutes, which is derived from the disposition of any school lands within the Province or within that part of the Northwest Territories now included within the boundaries thereof."

"7. The School Lands Fund to be transferred to the Province as aforesaid, and such of the school lands specified in section thirty-seven of the Dominion Lands Act, being chapter one hundred and thirteen of the Revised Statutes of Canada, 1927, as pass to the administration of the Province under the terms hereof, shall be set aside and shall continue to be administered by the Province in accordance, mutatis mutandis, with the provisions of sections thirty-seven to forty of the Dominion Lands Act, for the support of schools organized and carried on therein in accordance with the law of the Province."

AND WHEREAS the effect of these provisions is that money obtained from the sale of the school lands specified therein and the said School Lands Fund may be invested only in securities of Canada;

AND WHEREAS it has been agreed that provision should be made for the investment of such money in other securities as hereinafter provided:

NOW THEREFORE THIS AGREEMENT WITNESSETH THAT:

1.Paragraph seven of the Natural Resources Transfer Agreement is amended by adding thereto the following provision:

"The Province will, notwithstanding anything in this Agreement, invest money to which this Paragraph applies in securities of Canada, or of a Province, or of a municipal corporation or school district in the Province of Manitoba, or in securities guaranteed by Canada or a Province, to form a school fund, and will apply the interest arising therefrom, after deducting the cost of management, for the support of schools organized and carried on in accordance with the law of the Province."

2.This Agreement is made subject to its being approved by the Parliament of Canada and by the Legislature of the Province of Manitoba, and shall take effect on the first day of the calendar month beginning next after its approval as aforesaid, whichever approval, that of the Parliament of Canada or that of the Legislature of the Province, shall be later in date.

IN WITNESS WHEREOF the Honourable Douglas Charles Abbott, Minister of Finance, has hereunto set his hand on behalf of Canada; and the Honourable Douglas Lloyd Campbell, Premier of Manitoba, has hereunto set his hand on behalf of the Province of Manitoba.

ANNEXE

MÉMORANDUM DE LA CONVENTION

conclue le onzième jour de juin 1951

ENTRE

LE GOUVERNEMENT DU CANADA, représenté aux présentes par l'honorable Douglas Charles Abbott, ministre des Finances,

D'UNE PART,

ET

LE GOUVERNEMENT DE LA PROVINCE DU MANITOBA, représenté aux présentes par l'honorable Douglas Lloyd Campbell, premier ministre du Manitoba,

D'AUTRE PART.

CONSIDÉRANT que le Parlement du Canada et la Législature de la province ont dûment approuvé la convention conlue entre les parties aux présentes le quatorzième jour de décembre 1929 (ci-après appelée la Convention sur le transfert des ressources naturelles) et que, à la suite d'une adresse du Sénat et de la Chambre des Communes du Canada à Sa Majesté, ladite convention a été ratifiée et déclarée légalement exécutoire par une loi du Parlement du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord, intitulée : Acte de l'Amérique du Nord britannique, 1930, chapitre vingt-six des Statuts impériaux 20-21 George V;

CONSIDÉRANT que, d'après la clause vingt-quatre de ladite Convention sur le transfert des ressources naturelles, les stipulations de ladite convention peuvent être modifiées au moyen d'un accord ratifié par des lois correspondantes du Parlement du Canada et de la Législature de la province;

CONSIDÉRANT que les clauses six et sept de la Convention sur le transfert des ressources naturelles déclarent ce qui suit :

"6. Dès l'entrée en vigueur de la présente convention, le Canada transportera à la province les fonds ou valeurs qui constituent la partie de la caisse des terres d'écoles, créée sous l'autorité des articles vingt-deux et vingt-trois de l'Acte à l'effet d'amender et refondre les divers actes concernant les terres publiques fédérales, chapitre trente et un de quarante-deux Victoria, et des statuts subséquents, qui provient de l'aliénation de terres d'écoles situées dans la province ou dans la partie des territoires du Nord-Ouest maintenant comprise dans les limites de ladite province.

"7. La caisse des terres d'écoles à transférer à la province comme il est dit ci-dessus et les terres d'écoles mentionnées à l'article trente-sept de la Loi des terres fédérales, chapitre cent treize des Statuts revisés du Canada, 1927, qui passent à l'administration de la province en vertu des conditions stipulées aux présentes, doivent être mises de côté et continueront d'être administrées par la province, d'accord, mutatis mutandis, avec les dispositions des articles trente-sept à quarante de la Loi des terres fédérales, pour subvenir aux écoles y organisées et dirigées conformément à la loi de la province."

CONSIDÉRANT qu'en vertu de ces stipulations les deniers obtenus de la vente des terres d'écoles y spécifiées et ladite caisse des terres d'écoles ne peuvent être placés qu'en valeurs du Canada;

ET CONSIDÉRANT qu'il a été convenu de pourvoir au placement de ces deniers en d'autres valeurs, ainsi qu'il est stipulé ci-après;

À CES CAUSES, LA PRÉSENTE CONVENTION ATTESTE :

1.La clause sept de la Convention sur le transfert des ressources naturelles est modifiée par l'adjonction de la stipulation suivante :

"Nonobstant toute disposition de la présente convention, la province placera les deniers visés par la présente clause en valeurs du Canada, ou d'une province, ou d'une corporation municipale ou d'un district scolaire dans la province du Manitoba, ou en valeurs garanties par le Canada ou une province, pour constituer une caisse d'écoles, et en affectera les intérêts, après déduction des frais de gestion, au soutien des écoles organisées et dirigées d'après la loi de la province."

2.La présente convention est assujettie à l'approbation du Parlement du Canada et de la Législature de la province du Manitoba, et elle doit prendre effet le premier jour du mois civil qui commence immédiatement après l'approbation susdite, selon l'assentiment, ou du Parlement du Canada ou de la Législature de la province, qui est le dernier en date.

EN FOI DE QUOI l'honorable Douglas Charles Abbott, ministre des Finances, a apposé son seing aux présentes, au nom du Canada, et l'honorable Douglas Lloyd Campbell, premier ministre du Manitoba, y a apposé son seing au nom de la province du Manitoba.
