HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Agreement ratified and confirmed

1   An agreement dated the 19th day of April, 1948, and made between the Government of the Dominion of Canada, represented therein by the Honourable James Angus MacKinnon, Acting Minister of Mines and Resources, of the first part and the Government of the Province of Manitoba, represented therein by the Honourable John Stewart McDiarmid, Minister of Mines and Natural Resources, of the second part, and set forth in the Schedule, is hereby approved, ratified, and confirmed.

SCHEDULE

MEMORANDUM OF AGREEMENT, made this 19th day of April, 1948.

BETWEEN:

THE GOVERNMENT OF THE DOMINION OF CANADA, represented herein by the Honourable James Angus MacKinnon, Acting Minister of Mines and Resources,

OF THE FIRST PART;

AND

THE GOVERNMENT OF THE PROVINCE OF MANITOBA, represented herein by the Honourable John Stewart McDiarmid, Minister of Mines and Natural Resources,

OF THE SECOND PART.

WHEREAS the agreement entered into between the parties hereto on the 14th day of December, 1929 (hereinafter referred to as the Natural Resources Transfer Agreement) was duly approved by the Parliament of Canada and the Legislature of the Province, and upon an address to His Majesty from the Senate and House of Commons of Canada, was confirmed and declared to have the force of law by an Act of the Parliament of the United Kingdom of Great Britain and Northern Ireland entitled "The British North America Act, 1930", assented to on 10th July, 1930, being chapter twenty-six of the Imperial Statutes, 20-21 George V;

AND WHEREAS by paragraph twenty-four of the said Natural Resources Transfer Agreement it was agreed that the provisions of the said agreement might be varied by an agreement confirmed by concurrent statutes of the Parliament of Canada and the Legislature of the Province;

AND WHEREAS the said Natural Resources Transfer Agreement came into force pursuant to the provisions thereof, on the 15th day of July, 1930;

AND WHEREAS the provisions of the said Natural Resources Transfer Agreement were, pursuant to the provisions of said paragraph twenty-four thereof, varied by an agreement made between the Government of Canada of the first part and the Government of the Province of Manitoba of the second part, on the 5th day of March, 1938, and confirmed by concurrent statutes of the Parliament of Canada and the Legislature of the Province;

AND WHEREAS by paragraph two of the Natural Resources Transfer Agreement, the Province agreed that it would carry out, in accordance with the terms thereof every contract to purchase or lease any Crown lands, mines or minerals and every other arrangement whereby any person had become entitled to any interest therein as against the Crown, and further agreed not to affect or alter any term of any such contract to purchase, lease or other arrangement by legislation or otherwise, except either with the consent of all the parties thereto, other than Canada, or in so far as any legislation may apply generally to all similar agreements relating to lands, mines or minerals in the Province or to interests therein, irrespective of who might be the parties thereto;

AND WHEREAS it has been agreed between Canada and the said Province that the terms of said paragraph two should be further varied as herein set out;

NOW THEREFORE THIS AGREEMENT WITNESSETH THAT:

1.Paragraph two of the said Natural Resources Transfer Agreement is varied by adding at the end thereof, the following words:

"or except in so far as any legislation

(a) is legislation relating to the control and regulation of the generation, development, transformation, transmission, utilization, distribution, supply, delivery, dealing in, sale and use of electrical power and energy in Manitoba, and of the flow and right to the use, for the generation and development of such power and energy, or any other purpose connected therewith, of the water at any time in any river, stream, watercourse, lake, creek, spring, ravine, canyon, lagoon, swamp, marsh or other body of water within the Province and the taking, diversion, storage or pondage of such water for any of the said purposes, whether by restriction, prohibition or otherwise and whether generally or with respect to any specified area therein;

or

(b) is legislation providing for the taking, acquisition and purchase by agreement or compulsorily or otherwise or by expropriation of any indentures, agreements, arrangements, permits, interim permits, final licenses, licenses, interim licenses, leases, interim leases, rights, liberties, privileges, easements, benefits, advantages or other concessions of any person of whatever nature, in relation to the flow and right to the use of the said water or the taking, diversion, storage or pondage thereof for the generation and development of electric power and energy, the utilization, transmission, distribution and sale of such power and energy, the occupation and use of Crown lands of the Province for the maintenance and operation of hydro-electric and other works of any person and any other rights, liberties, privileges, easements, benefits, advantages and concessions connected therewith or incidental or appurtenant thereto;

or

(c) is legislation providing for the taking, acquisition and purchase by agreement or compulsorily or otherwise or by expropriation of any property, works, plant, lands, easements, rights, privileges, machinery, installations, materials, devices, fittings, apparatus, appliances and equipment of any person constructed, acquired or used in the generation, development or transmission of such power and energy or in the taking, use, diversion, storage or pondage of said water, and whether generally in the said Province or in any specified area therein".

2.This agreement is made subject to its being confirmed by the Parliament of Canada and by the Legislature of the Province of Manitoba, and shall take effect on the first day of the calendar month beginning next after its confirmation as aforesaid whichever approval, that of the Parliament of Canada or that of the Legislature of the Province, shall be later in date.

IN WITNESS WHEREOF the Honourable James Angus MacKinnon, Acting Minister of Mines and Resources, has hereunto set his hand on behalf of the Dominion of Canada; and the Honourable John Stewart McDiarmid, Minister of Mines and Natural Resources, has hereunto set his hand on behalf of the Province of Manitoba.

MEMORANDUM DE LA CONVENTION conclue le dix-neuvième jour d'avril 1948,

ENTRE:

LE GOUVERNEMENT DU CANADA, représenté aux présentes par l'honorable James Angus MacKinnon, ministre suppléant des Mines et des ressources,

D'UNE PART,

ET

LE GOUVERNEMENT DE LA PROVINCE DU MANITOBA, représenté aux présentes par l'honorable John Stewart McDiarmid, ministre des Mines et des ressources naturelles,

D'AUTRE PART.

CONSIDÉRANT que le Parlement du Canada et la Législature de la Province ont dûment approuvé la convention conclue entre les parties aux présentes le quatorzième jour de décembre 1929 (ci-après appelée la Convention sur le transfert des ressources naturelles) et que, à la suite d'une adresse du Sénat et de la Chambre des Communes du Canada à Sa Majesté, ladite convention a été ratifiée et déclarée légalement exécutoire par une loi du Parlement du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord, intitulée: Acte de l'Amérique Britannique du Nord, 1930, sanctionnée le 10 juillet 1930, soit le chapitre vingt-six des Statuts impériaux 20-21 George V;

CONSIDÉRANT que par la clause vingt-quatre de ladite Convention sur le transfert des ressources naturelles, les stipulations de ladite convention peuvent être modifiées au moyen d'un accord ratifié par des lois correspondantes du Parlement du Canada et de la Législature de la Province;

CONSIDÉRANT que ladite Convention sur le transfert des ressources naturelles est entrée en vigueur le 15e jour de juillet 1930, conformément à ses stipulations;

CONSIDÉRANT que les dispositions de ladite Convention sur le transfert des ressources naturelles ont été modifiées en vertu des stipulations de ladite clause vingt-quatre par un accord entre le Gouvernement du Canada, d'une part, et le Gouvernement de la province du Manitoba, d'autre part, le 5e jour de mars 1938, et ratifiées par des lois correspondantes du Parlement du Canada et de la Législature de la Province;

CONSIDÉRANT que, par la clause 2 de la Convention sur le transfert des ressources naturelles, la Province s'est engagée à exécuter, en conformité des stipulations pertinentes, tout contrat d'achat ou de location de terres, mines ou minéraux de la Couronne et tout autre arrangement investissant quelque personne d'un intérêt dans les susdits à l'encontre de la Couronne, et qu'elle s'est engagée, en outre, à n'affecter ni modifier aucune condition de pareil contrat d'achat ou de location ou de pareil autre arrangement, par législation ou autrement, sauf du consentement de toutes les parties à ce contrat ou à cet arrangement, autres que le Canada, ou en tant qu'une législation peut s'appliquer généralement à tous semblables accords relatifs aux terres, mines ou minéraux dans la Province ou à quelque intérêt dans ceux-ci, indépendamment des personnes qui pourraient y être parties;

À CES CAUSES, LA PRÉSENTE CONVENTION ATTESTE QUE:

1.Est modifiée la clause deux de ladite Convention sur le transfert des ressources naturelles par l'adjonction, à la fin, des mots suivants:

"ou sauf dans la mesure où quelque législation

a) stipule le contrôle et la réglementation de la production, du développement, de la transformation, transmission, utilisation, distribution, fourniture, livraison, commerce, vente et emploi de la force et de l'énergie électriques au Manitoba, et de l'écoulement, en vue de la production et du développement de cette force et énergie, ou pour toute autre fin connexe, et du droit d'utiliser pour lesdites fins, l'eau se trouvant pour lors dans tout fleuve, rivière, cours d'eau, lac, ruisseau, source, ravin, canon, lagune, marécage, marais ou autre masse d'eau situé dans la Province, et sur la prise, dérivation, emmagasinage ou accumulation de cette eau pour l'une desdites fins, que ce soit par restriction, interdiction ou autrement et de façon générale ou à l'égard d'une région spécifiée qui s'y trouve;

ou

b) stipule la prise, l'acquisition et l'achat par convention ou obligatoirement, ou d'autre manière, ou par expropriation, de tout contrat, convention, arrangement, permis, permis provisoire, licence définitive, licence, licence provisoire, bail, bail provisoire, droit, franchise, privilège, servitude, bénéfice, avantage ou autre concession de toute personne, quelle qu'en soit la nature, relativement à l'écoulement de ladite eau et au droit d'utiliser cette eau, ou à la prise, dérivation, emmagasinage ou accumulation de cette eau pour la production et le développement de la force et de l'énergie électriques, l'utilisation, la transmission, la distribution et la vente de cette force et énergie, l'occupation et l'emploi de terres de la Couronne de la Province pour l'entretien et l'exploitation d'ouvrages hydro-électriques et autres de toute personne, ainsi que tous autres droits, franchises, privilèges, servitudes, bénéfices, avantages et concessions y connexes, ou qui s'y rattachent ou s'y rapportent;

ou

c) stipule la prise, l'acquisition et l'achat par convention ou obligatoirement, ou d'autre manière, ou par expropriation, de biens-fonds, ouvrages, usines, terrains, servitudes, droits, privilèges, outillages, installations, matériaux, mécanismes, agencements, appareils, accessoires et équipements de toute personne, construits, acquis ou utilisés dans la production, le développement ou la transmission de cette force et énergie ou dans la prise, l'utilisation, la dérivation, l'emmagasinage ou l'accumulation de ladite eau, et soit de façon générale dans ladite province, soit dans une région spécifiée qui s'y trouve."

2.La présente convention est assujettie à la ratification du Parlement du Canada et de la Législature de la province du Manitoba, et elle doit entrer en vigueur le premier jour du mois civil qui commence immédiatement après sa ratification susdite, selon l'approbation, ou du Parlement du Canada ou de la Législature de la Province, qui est la dernière en date.

EN FOI DE QUOI l'honorable James Angus MacKinnon, ministre suppléant des Mines et des ressources, a apposé son seing aux présentes, au nom du Dominion du Canada, et l'honorable John Stewart McDiarmid, ministre des Mines et des ressources naturelles, y a apposé son seing au nom de la province du Manitoba.
