Regulations
5(1) For the purpose of carrying out the provisions of this Act according to their intent, the Lieutenant Governor in Council may make such regulations and orders as are ancillary thereto and are not inconsistent therewith; and every regulation or order made pursuant to, and in accordance with, the authority granted by this section shall have the force of law; and, without restricting the generality of the foregoing, the Lieutenant Governor in Council may make regulations and orders respecting
(a) the approval, and the imposition of conditions with regard to the design, registration of design, construction, inspection, inspection during construction, identification, testing, installation, service requirements, operation, maintenance, repair, and alteration, of any designated article;
(b) governing the classification of any designated article;
(c) specifying the equipment that must be operated or used with a designated article;
(d) adopting and constituting as regulations with respect to any matter mentioned in clauses (a), (b), or (c)
(i) any relevant codes, rules, or standards, or
(ii) any such codes, rules or standards with the exception of any specified provisions thereof, or
(iii) any specified provisions of any such codes, rules, or standards, or
(iv) any amendments to any such codes, rules, or standards, with or without modification,
either in place of, or in addition to, any regulation made under clauses (a), (b), and (c), or any of them;
(e) the issue of licences under this Act;
(f) the issue of permits for the purpose mentioned in subsection 3(1);
(g) fees to be paid for any licence or permit issued under this Act;
(h) any of the matters mentioned in subsection 2(3) and in connection therewith for adopting and constituting as regulations all or any part of any relevant codes, rules or standards or any amendments to such codes, rules or standards, with or without modification.
Règlements
5(1) Le lieutenant-gouverneur en conseil peut prendre des règlements et des décrets d'application compatibles avec la présente loi et conformes à son esprit; ces règlements et ces décrets ont force de loi. Il peut notamment, par règlement et par décret :
a) approuver et imposer des conditions relativement à la conception des articles désignés et à son enregistrement, ainsi qu'à la construction, à l'inspection, à l'inspection en cours de construction, à l'identification, aux essais, à l'installation, à l'entretien, au fonctionnement, aux réparations et aux transformations de ces articles désignés;
b) classer les articles désignés;
c) désigner le matériel qui doit fonctionner ou être utilisé avec les articles désignés;
d) adopter et prendre à titre de règlements applicables aux dispositions de l'alinéa a), b) ou c), soit au lieu, soit en plus d'un règlement pris en application de cet alinéa :
(i) les codes, règles ou normes pertinents,
(ii) ces codes, ces règles ou ces normes à l'exception de dispositions mentionnées,
(iii) les dispositions mentionnées de ces codes, de ces règles ou de ces normes,
(iv) les modifications de ces codes, de ces règles ou de ces normes, avec ou sans changements;
e) délivrer des licences en vertu de la présente loi;
f) délivrer des permis aux fins visées au paragraphe 3(1);
g) fixer les droits à acquitter pour une licence ou un permis délivré en vertu de la présente loi;
h) traiter les questions visées au paragraphe 2(3) et toute question connexe, en vue d'adopter et de prendre à titre de règlements tout ou partie des codes, règles ou normes pertinents ou toute modification s'y rapportant, avec ou sans changements.
