An Act Respecting Debts Owing by Municipalities to School Districts

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definitions

In this Act,

"land" includes land, messuages, tenements, and hereditaments, corporeal or incorporeal, of every kind and description, whatever the estate or interest therein, whether legal or equitable; (« bien-fonds »)

"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act; (« ministre »)

"municipality" means any locality the inhabitants of which are incorporated and continued under the authority of The Municipal Act, and includes a rural municipality and an incorporated town or village. (« municipalité »)

Minister may require inquiry and report

At the request and expense of a municipality, the minister may require an inquiry to be made into the state of the accounts between the municipality and any school district; and the minister shall, upon the completion of the inquiry, report thereon to the municipality, the school district or districts concerned, and the Minister of Education, Citizenship and Youth.

On agreement, minister may extend time for payment

Where the municipality and the school district or districts, or any of them, agree that the whole or any part of any moneys past due by the municipality to any school district should be discharged or released or the time for payment thereof extended, and advise the minister of the agreement, the minister, with the approval of the Minister of Education, Citizenship and Youth, shall cause to be made all necessary entries in the books of the municipality to carry out the agreement; and the clerk of the municipality shall make such entries in the books of the municipality.

Where the municipality and the school district or districts or any of them concerned fail to agree as to the amount to be discharged or released or extended as aforesaid, on the recommendation of the minister and the Minister of Education, Citizenship and Youth, the Lieutenant Governor in Council may, by order, discharge or release, in whole or in part, or extend the time for payment of any moneys past due by the municipality to any school district; and thereupon the minister shall cause to be made all necessary entries in the books of the municipality to carry out the order of the Lieutenant Governor in Council, and the clerk of the municipality shall make such entries in the books of the municipality.
