The Constitutional Questions Act is amended. The Lieutenant Governor in Council must seek the Court of Appeal's opinion when a declaration under section 33 of the Canadian Charter of Rights and Freedoms (the "notwithstanding clause") is made in an Act of the Legislature.

La Loi sur les questions constitutionnelles est modifiée. Le lieutenant-gouverneur en conseil doit solliciter l'opinion de la Cour d'appel lorsqu'une loi de la Législature comporte une déclaration permise par l'article 33 de la Charte canadienne des droits et libertés (« disposition de dérogation »).

  

WHEREAS our parliamentary democracy consists of three branches of government: the executive, the legislature and the judiciary;

AND WHEREAS section 33 of the Canadian Charter of Rights and Freedoms, the "notwithstanding clause", recognizes and preserves the role of the legislature in having the final word on important matters of public policy;

AND WHEREAS invoking the notwithstanding clause overrides protected rights for a period of five years and may be renewed after that;

AND WHEREAS any override of the fundamental rights and freedoms that define our constitutional democracy and reflect the core values of a free and just society should be subject to the highest levels of transparency, scrutiny and accountability;

AND WHEREAS the judiciary has a vital function to play in our democratic process by providing the people of Manitoba with reliable and impartial information about the effect of legislation on Charter rights;

AND WHEREAS the distribution of powers under the Constitution of Canada means that any invocation of the notwithstanding clause at the federal level would concern a federal power and may provide limited insight into the effects of invoking the notwithstanding clause at the provincial level;

Attendu :

que notre démocratie parlementaire comporte trois branches de gouvernement : le pouvoir exécutif, le pouvoir législatif et l'appareil judiciaire;

que l'article 33 de la Charte canadienne des droits et libertés, soit la disposition de dérogation, reconnaît et maintien le rôle de la branche législative, qui a le dernier mot sur les questions importantes de politique publique;

que le recours à la disposition de dérogation a pour effet de suspendre des droits garantis par la Charte pendant cinq ans, après quoi il est possible d'avoir de nouveau recours à cette disposition;

que le fait de suspendre les droits et libertés fondamentaux qui définissent notre démocratie constitutionnelle et qui reflètent nos valeurs primordiales en tant que société libre et juste devrait être assujetti aux plus hauts niveaux de transparence, de contrôle et de responsabilisation;

que la branche judiciaire joue un rôle essentiel dans notre processus démocratique en fournissant à la population manitobaine de l'information fiable et impartiale au sujet de l'effet de mesures législatives sur les droits garantis par la Charte;

que dans le contexte de la distribution des pouvoirs prévue dans la Constitution du Canada, le recours à la disposition de dérogation vise un pouvoir fédéral et que la capacité d'en saisir la portée au niveau provincial peut être limitée,

THEREFORE HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

1   The Constitutional Questions Act is amended by this Act.

2   The following is added after section 1:

Reference — use of notwithstanding clause

1.1(1)   If an Act of the Legislature contains a declaration pursuant to section 33 of the Canadian Charter of Rights and Freedoms stating that a provision of the Act operates notwithstanding a provision of the Charter, the Lieutenant Governor in Council shall refer the Act to the Court of Appeal in accordance with this section, and the court shall consider the matter.

Renvoi — recours à la disposition de dérogation

1.1(1)   S'il est déclaré dans une loi de la Législature, comme le permet l'article 33 de la Charte canadienne des droits et libertés, qu'une disposition de cette loi a effet indépendamment d'une disposition de la Charte, le lieutenant-gouverneur en conseil renvoie la loi à la Cour d'appel en conformité avec le présent article. Suite au renvoi, la Cour d'appel examine l'affaire.

Content of referral

1.1(2)   The referral shall seek the opinion of the court on whether

(a) the provision of the Act violates section 2 or sections 7 to 15 of the Charter; and

(b) if so, whether the provision of the Act is reasonable and demonstrably justified pursuant to section 1 of the Charter.

Contenu du renvoi

1.1(2)   Le renvoi doit solliciter l'opinion de la Cour d'appel à savoir si la disposition de la loi contrevient à l'article 2 ou aux articles 7 à 15 de la Charte et, dans l'affirmative, si elle est raisonnable et si sa justification peut se démontrer, comme le prévoit l'article 1 de la Charte.

Timing of referral

1.1(3)   The referral must be made within 90 days after the enactment of the Act.

1.1(3)   Le renvoi doit être fait dans les 90 jours suivant l'édiction de la loi.

Coming into force

3   This Act comes into force on the day it receives royal assent.

Entrée en vigueur

3   La présente loi entre en vigueur le jour de sa sanction.
