The Victims' Bill of Rights Amendment Act

Explanatory Note

This note was written as a reader's aid to the Bill and is not part of the law.

This Bill amends The Victims' Bill of Rights to enable the director to pay compensation to the family members of a victim despite the victim's conviction for certain offences. Currently, family members are ineligible if the victim's criminal record includes a conviction for any of those offences.

An amendment is also made to allow a victim in a sexual assault case to receive, at no cost, independent legal representation if the victim's personal information is sought to be used as evidence by the accused.

Two provisions in the French version are clarified.

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Victims' Bill of Rights is amended by this Act.

Section 24 of the French version is replaced with the following:

Le directeur général de la Société d'aide juridique du Manitoba veille à ce que les victimes qui en font la demande reçoivent des renseignements concernant, à la fois :

a) la possibilité d'obtenir des conseils juridiques sur leurs droits;

b) le droit de demander d'autres services d'aide juridique.

Section 25 is amended

(a) by adding "or an application is made under section 278.93 of the Code to determine whether evidence about the victim or records relating to the victim are admissible" at the end; and

(b) in the French version, by adding "qui en font la demande" after "victimes".

Subsection 54.1(2) is amended by striking out "if the victim has" and substituting "to a victim if they have".

Subsection 54.1(3) is amended, in the part before clause (a), by striking out "under this Part if" and substituting "to a victim under this Part if".

Subsection 54.1(4) is amended

(a) in the section heading, by striking out "conviction for non-prescribed offences" and substituting "victim's convictions";

(b) by adding "to a victim, the spouse or common-law partner of a victim or a parent, child or sibling of a victim" after "under this Part"; and

(c) by striking out "— other than a prescribed offence —".

Coming into force

This Act comes into force on a day to be fixed by proclamation.
