The Liquor, Gaming and Cannabis Control Amendment Act

Explanatory Note

This note was written as a reader's aid to the Bill and is not part of the law.

This Bill amends The Liquor, Gaming and Cannabis Control Act. It prohibits cannabis consumption in public places, unless the consumption is permitted by regulation or under The Smoking and Vapour Products Control Act.

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Liquor, Gaming and Cannabis Control Act is amended by this Act.

Section 101.1 is amended by renumbering it as subsection 101.1(1) and adding the following as subsection 101.1(2):

Interpretation — consuming cannabis

101.1(2)

For the purpose of this Part, a person consumes cannabis if they inhale, ingest or otherwise introduce cannabis into their body by any method.

The following is added after section 101.18:

No cannabis consumption in public places

101.18.1

Except as permitted by regulation or under The Smoking and Vapour Products Control Act, a person must not consume cannabis in a public place.

The following is added as clause 157(2)(dd.18):

(dd.18) for the purposes of section 101.18.1,

(i) specifying the places, times or circumstances when a person may consume cannabis in a public place,

(ii) prescribing the types or classes of cannabis that may be consumed in a public place, and

(iii) prescribing methods of cannabis consumption that are permitted in a public place;

This Act comes into force on a day to be fixed by proclamation.
