The Legal Aid Manitoba Amendment Act

Explanatory Note

This note was written as a reader's aid to the Bill and is not part of the law.

Currently, the tariff of fees paid to solicitors for providing legal aid is set by regulation under The Legal Aid Manitoba Act. This Bill amends the Act to require the management council of Legal Aid Manitoba to establish the fees.

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Legal Aid Manitoba Act is amended by this Act.

In section 1 of the French version, the definition "conseil" is amended by striking out "d'administration" and substituting "de gestion".

Section 6.1 is replaced with the following:

Council must establish tariff

6.1(1)

The council must establish a tariff of fees to be paid to solicitors for providing legal aid, and the manner of taxation of bills of costs under section 16.

6.1(2)

The council must make the tariff available to the public on the council's website or in any other form the council considers appropriate.

Subsection 16(2) is replaced with the following:

Taxation of bill

16(2)

A bill submitted under subsection (1) shall be taxed by the executive director on the basis of the tariff and in the manner established by the council.

Clauses 29(e) and (f) are repealed.

Coming into force

This Act comes into force on a day to be fixed by proclamation.
