The Highway Traffic Amendment Act (Impaired Driving Offences)

Explanatory Note

This note is a reader's aid and is not part of the law.

Amendments made by The Impaired Driving Offences Act (Various Acts Amended) to The Highway Traffic Act effective December 18, 2018 reflect changes to the driving-related provisions of the Criminal Code. This Act corrects a legislative gap created by those amendments.

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. H60 amended

The Highway Traffic Act is amended by this Act.

Clause 242.1(1.1)(a) is amended by striking out "subsection 259(4) (operation while disqualified)" and substituting "subsection 320.18(1) (operation while prohibited)".

Clause 263.1(2)(d) is amended by striking out everything after "a demand" and substituting "made under section 320.27 or 320.28 of the Criminal Code, or with the peace officer's instructions in respect of the demand;".

Subsection 263.2(7) is amended

(a) in clause (b), by striking out "paragraph 253(3)(a)" and substituting "paragraph 320.14(1)(c)";

(b) in clause (c), by striking out "paragraph 253(3)(c)" and substituting "paragraph 320.14(1)(d)"; and

(c) in clause (d), by striking out everything after "a demand" and substituting "made under section 320.27 or 320.28 of the Criminal Code, or with the peace officer's instructions in respect of the demand;".

Coming into force

This Act comes into force immediately after Part 2 of The Impaired Driving Offences Act (Various Acts Amended), as enacted by S.M. 2018, c. 19, comes into force.
