The University of Manitoba Students' Union Amendment Act

Explanatory Note

This note is a reader's aid and is not part of the law.

This Act amends The University of Manitoba Students' Union Act. Any increase in students' annual membership fees must first be approved by a majority of students voting in a referendum. Certain requirements must also be met for UMSU to become and remain a member of an external organization.

The Act also contains amendments making the private Act gender neutral, and corrects a cross-reference numbering error.

WHEREAS The University of Manitoba Students' Union was incorporated by The University of Manitoba Students' Union Act, S.M. 1975, c. 58, and was continued by The University of Manitoba Students' Union Act, R.S.M. 1990, c. 203;

AND WHEREAS The University of Manitoba Students' Union has received the consent of the Board of Governors of the University to petition the Legislature to amend The University of Manitoba Students' Union Act, in accordance with section 21 of that Act;

AND WHEREAS The University of Manitoba Students' Union has presented a petition requesting the following amendments to The University of Manitoba Students' Union Act, and it is appropriate to grant the petition;

THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

R.S.M. 1990, c. 203 amended

The University of Manitoba Students' Union Act is amended by this Act.

Subsection 6(1) of the English version is amended

(a) by striking out "his" and substituting "the person's"; and

(b) by striking out "he" and substituting "the person".

Clause 8(f) is amended by adding "section 8.1 and" after "subject to".

The following is added after clause 8(f):

(f.1) provide for all matters respecting the conduct of a referendum;

The following is added after section 8:

Increase in annual membership fees must be approved by referendum

8.1(1)

Before submitting to the Board of Governors a request to approve an increase in the amount of annual membership fees payable by members of the corporation, the council must have conducted a referendum of the members of the corporation on the question of the increase, in which the increase was approved by a majority of the votes cast. The referendum must have been conducted in accordance with the by-laws under clause 8(f.1).

Not applicable to CPI indexation increases

8.1(2)

This section does not apply to an increase in the amount of annual membership fees resulting from indexation based on the consumer price index.

Membership in an external organization must be approved by referendum

8.2(1)

The corporation must not become a member of an external organization unless the council has first conducted a referendum of the members of the corporation on the question of the membership, in which the membership was approved by a majority of the votes cast. The referendum must have been conducted in accordance with the by-laws under clause 8(f.1).

Periodic renewal of membership

8.2(2)

For greater certainty, subsection (1) does not apply to the periodic renewal of the corporation's membership in an external organization.

Membership to be affirmed every two years

8.2(3)

The corporation's membership in an external organization must be affirmed by a majority vote of the council every second calendar year.

If membership not affirmed

8.2(4)

If the corporation's membership in an external organization is voted on by the council and is not affirmed by a majority vote, the council must take all required steps to terminate that membership.

Section 12 of the English version is amended by striking out "his" and substituting "their".

Section 15 of the English version is amended by striking out "he is" and substituting "they are".

Section 16 of the English version is amended

(a) by striking out "his" and substituting "the person's"; and

(b) by striking out "him" and substituting "the person".

Section 18 is amended by striking out "Subject to subsection (1)" and substituting "Subject to section 17".

TRANSITIONAL AND COMING INTO FORCE

Transitional — membership in external organizations

The following applies with respect to the corporation's membership in an external organization in effect on the day this section comes into force:

(a) subsection 8.2(1) of The University of Manitoba Students' Union Act, as enacted by section 4 of this Act, does not apply;

(b) the first affirmation vote under subsection 8.2(3) of The University of Manitoba Students' Union Act, as enacted by section 4 of this Act, must occur within six months after the day this section comes into force.

Coming into force

This Act comes into force on the day it receives royal assent.
