The Consumer Protection Amendment Act (Gift Card Inactivity Fees)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. C200 amended

The Consumer Protection Act is amended by this Act.

Section 173 is amended by renumbering it as subsection 173(1) and adding the following as subsection 173(2):

Restriction on inactivity fees

173(2)

Despite clause (1)(f), a regulation governing the fees that may be charged in relation to prepaid purchase cards may not authorize an inactivity fee in relation to a prepaid purchase card that was issued or sold for cash or other consideration.

Coming into force

This Act comes into force on a day to be fixed by proclamation.
